RECOVERY OF STOLEN PUBLIC FUNDS
1. EACC has recovered Kes. 11,493,000 stolen from Chebororwa Agricultural Training Centre in Uasin Gishu County by former Principal Nicholas Kirop Kaino, the Principal’s wife Rose Rotich, and former District Accountant for Marakwet West Sub-County Alison Odera Mkangula.
2. Investigations established that between 23rd February 2017 and 19th May 2017, the Principal and District Accountant in abuse of their authority as signatories to the college bank account conspired and embezzled all the funds in the subject account to the tune of Kes. 11,493,000/=. At the time of the withdrawals, Nicholas Kirop Kaino had left the institution and was no longer the Principal. He had not handed over the signatory role to the new Principal.
3. The Principal and District Accountant executed the fraud through various cheques drawn in their favour and in favour of four (4) business entities associated with them namely Rotkan Investments, Wagabi Enterprises, Jergens Enterprises and Forgill Agencies, which did not supply anything to the institution. Rotkan Investments belonged to the Principal and his wife while the other three entities were linked to the District Accountant.
4. In her judgement, Justice Esther Maina, sitting at Milimani Law Courts in Nairobi, ordered the defendants to pay the Government the money stolen together with an annual interest of 12% from the date the theft took place in 2017.
5. EACC filed the case on 19th September 2019 following receipt of a complaint on 7th November 2017 from the then County Secretary for Uasin Gishu alleging the illegal withdrawal of funds.
