Conservatives, GOP lawmakers and critics are outraged over the California law that they say effectively legalizes the k*lling of newborns up to 28 days after birth by substituting the term "perinatal" for "prenatal" in key provisions, essentially sanctioning infanticide under the guise of reproductive rights.
The bill was signed by Gov. Gavin Newsom in September of 2023 as part of measures that solidified California's status as a sanctuary for abortion access.
Supporters of the bill said it was a protection against women being criminally charged in cases of miscarriage, stillbirth, and other pregnancy losses.
However, conservatives say the bill represents an expansion of radical abortion policies, prioritizing unrestricted "reproductive justice" over the sanctity of life
In the bill, 'perinatal death' is referenced, a term defined in California Welfare and Institutions Code as the time between conception through one month post delivery.
Critics, including groups like the California Family Council and Right to Life League warned that the original draft's phrasing—"perinatal death" without qualifiers—could protect people who caused an infant to die after birth, like from neglect or harm.
It would also immunize acts leading to an infant's death shortly after birth, from neglect or harm, if tied loosely to pregnancy-related issues.
Pro-life activists labeled it the "infanticide bill" and thousands protested said it blurred the line between abortion and post-birth homicide.
Due to.the backlash, the bill was amended.
The final version, specifies protections against civil or criminal liability only for "perinatal death due to causes that occurred in utero" - meaning if the baby died with in a month after birth because of something that happened before the baby was born, like congenital defects, there would be no criminal charges.
Fact-checkers like PolitiFact say the infanticide claims are false, adding that existing homicide laws are still valid, and that the bill does not decriminalize intentional infant k*lling.
