ಸಿವಿಲ್ ಕೇಸ್‌ ಬಾಕಿ ಇದೆ ಎಂಬ ಕಾರಣಕ್ಕೆ ಪೊಲೀಸರಿಗೆ ಕಾನೂನನ್ನು ಕೈಗೆತ್ತಿಕೊಳ್ಳುವ ಅಧಿಕಾರ ಸಿಗುವುದಿಲ್ಲ.

ಆಸ್ತಿ, ಹಣ, ಒಪ್ಪಂದ ಅಥವಾ ಹಕ್ಕಿನಂತಹ ಸಿವಿಲ್ ವಿವಾದಗಳನ್ನು ಪೊಲೀಸ್ ಠಾಣೆಯಲ್ಲಿ ಬೆದರಿಕೆ, ಒತ್ತಡ ಅಥವಾ ಬಲಪ್ರಯೋಗದ ಮೂಲಕ ಬಗೆಹರಿಸುವುದು ಕಾನೂನುಬಾಹಿರ.

ಪೊಲೀಸ್ ಅಧಿಕಾರಿಗಳು ತಮ್ಮ ಅಧಿಕಾರದ ಮಿತಿಯನ್ನು ಮೀರಿ ನಾಗರಿಕರ ವಿರುದ್ಧ ಕ್ರಮ ಕೈಗೊಂಡರೆ, ಅಧಿಕಾರದ ದುರುಪಯೋಗಕ್ಕೆ ನ್ಯಾಯಾಲಯವೇ ಕಡಿವಾಣ ಹಾಕಬಹುದು.

₹3 ಲಕ್ಷ ದಂಡ ಸೇರಿದಂತೆ ACP, DCP ಮಟ್ಟದ ಅಧಿಕಾರಿಗಳ ವಿರುದ್ಧವೂ ಕಠಿಣ ನಿಲುವು ತೆಗೆದುಕೊಂಡಿರುವ ನ್ಯಾಯಾಲಯದ ಸಂದೇಶ ಸ್ಪಷ್ಟ:

“ಪೊಲೀಸ್ ಇಲಾಖೆ ಕಾನೂನಿಗಿಂತ ಮೇಲಲ್ಲ.
ಅಧಿಕಾರ ಎಂದರೆ ಜನರನ್ನು ಬೆದರಿಸುವ ಪರವಾನಗಿ ಅಲ್ಲ.”

ಸಿವಿಲ್ ಹಕ್ಕುಗಳ ವಿಚಾರವನ್ನು ಪೊಲೀಸ್ ಬಲದಿಂದ ಬದಲಾಯಿಸಲು ಸಾಧ್ಯವಿಲ್ಲ.
ಕಾನೂನು ಪಾಲಿಸಬೇಕಾದವರು ಮೊದಲು ಕಾನೂನಿನ ಮಿತಿಯನ್ನು ಗೌರವಿಸಬೇಕು.
