1. SC/ST act was passed on 11 Sep, 1989 (by Rajiv Gandhi govt).

2. It was notified on 29 Jan, 1990 (by VP Singh govt, supported by BJP).

3. Major changes introduced in SC/ST act during 2014-2016 (BJP tenure):
-Enhanced relief amounts (up to 8.5 lakhs)
-Relaxed payment structure
-Faster payment
-Increased offenses from 22 to 47
-A stricter presumption of guilt
-Mandatory & exclusive special courts

4. In 2018, Supreme Court introduced 3 safeguards saying act was misused for blackmail (in Kashinath Mahajan case). But BJP passed an amendment to nullify the Supreme Court judgement & added section 18A, which added following provisions:
-No preliminary inquiry
-No bail
-No prior approval for arrest (for public servants)

5. Multiple high courts, police reports, NCRB reports show the act being misused, esp for monetary compensation.
But instead of stopping the misuse, what BJP govt is doing?
-Planning 40% increase in compensation amount (upto 12 lakhs)

So, Inference?
- If BJP govt had not nullified the Supreme Court judgement, @ajeetbharti would have been safe.
But because of section 18A, added by BJP, his bail was denied.

-If BJP had not increased the compensation amounts or made the payment easier/faster without any scrutiny, the maximum misuse could have been prevented.

-If BJP had not added provision of denial of bail/no preliminary enquiry (18A again), the act wouldn't have become draconian and used for blackmailing people

-Despite rampant misuse, and knowing that money is the primary factor, instead of taking actions to prevent misuse, if you increase the monetary compensation, it only means you want to promote misuse.

So yes, it is aptly called "Modi Act".
