Let’s talk about how smell became part of the legal foundation for segregation in the States.
Segregation enforced a strict separation of life for Black and white people, including separate public spaces like schools and railroad cars. It relied on the idea that race could be visually detected and confirmed.
In New Orleans, a group of civil rights activists challenged this law by having Homer Plessy, a man who could pass as white, but who was considered to be Black under Louisiana law, enter a whites-only railroad car.
He was arrested and charged and the case went to criminal court. This was the intended effect; the idea was to undermine the law by proving race often isn’t identifiable by sight.
The prosecuting attorney, however, stated that he didn’t need to be able to see Plessy to identify his race - he could *smell* it. Plessy was found guilty by the judge, John Ferguson. Plessy’s case was appealed, but the Supreme Court ruled against him also in 1897.
Plessy paid a fine rather than accepting jail time, but his case set a precedent, legitimising illusory notions about racial odours and reinforcing the legal foundations of segregation.
