Our father acquired an 18-acre parcel of land in Loresho in the 1990s, valued today at approximately KSh 1.3 billion, and has been in possession ever since. He holds a title that was issued by the Land Registrar at the time, and he has maintained ownership for over three decades. Shortly after the change in government regime, individuals emerged alleging parallel ownership of the land.

After noticing suspicious activities around the property, our father reported the matter to the DCI and requested that investigations be carried out. However, in a turn of events, he was instead accused of holding a fake title. The matter proceeded to the High Court (Environment and Land Court- which is primarily mandated to determine ownership of land). The case proceeded, and a ruling was delivered in favour of Davis Chelogoi, maintaining the status quo pending conclusion of the case.

However, the individuals claiming ownership later introduced criminal charges against our father in what amounts to an attempt to intimidate him into surrendering the land. The matter was taken to the Magistrate’s Court, which ordered the arrest of our father despite existing standing orders from a higher court. Following this, the individuals claiming ownership forcefully took over the property, and the dispute has now been in court for approximately two years. During this period, the proceedings have been marked by significant procedural irregularities, compromised actions, and threats directed at our father.

We have presented substantial evidence supporting our father’s ownership, including a witness statement from the Land Registrar confirming that at the time of issuance, our father’s title was the only existing title for the property. In addition, forensic analysis confirmed the authenticity of the registrar’s signature. Furthermore, the root of the claimant’s documents traces back to a completely different property, raising serious questions about the legitimacy of the claim. Despite this, the case has continued under these circumstances, with efforts by our father and his legal team repeatedly frustrated.

To add to this, the individual currently claiming ownership had previously faced charges relating to holding a fake title, but the matter did not proceed after investigation files went missing.

There has also been interference with our father’s initial complaint, where records and evidence went missing. We have experienced direct and indirect threats, alongside attempts at witness intimidation and tampering, including pressure placed on key individuals and last-minute changes in court proceedings. Suspicious parties have repeatedly appeared during proceedings despite having no legitimate role in the matter.

Given these circumstances, all attempts to obtain a fair and impartial hearing have been compromised. We are therefore appealing for an opportunity for our father to publicly share his side of the story, present the documentation, and allow the public to understand the full context of this dispute.
We have comprehensive documentation, court records, forensic reports, and supporting statements available, and we are willing to provide them for your review. We would greatly appreciate the opportunity to discuss this further and explore the possibility of featuring this story.
