Dipankar Datta is behaving like a judicial dictator; It’s the job of the parliament to make laws and NOT Judiciary’s.

That 2023 judgement where judiciary poked nose in the similar constitutional body by appointing CJI as one of the selector was a clear overreach, Parliament cleared that by law;

Now Dipankar Datta is behaving like a dictator who doesn’t want the control to go away;

This is more embarrassing for judiciary to have an idiot like him and dictating on such important issues; He’s surely playing for ulterior motives. His tone and behaviour was enough- I’m not even getting into his legal arguments.

Apropos observations by Justice Dutta in EC appointments

If you look at the trajectory of SC judgements in matters of appointments:

1. CVC cannot be appointed by government
2. CBI Chief cannot be appointed by government
3. Director ED cannot be appointed by government
4. DGP cannot be appointed by (state) government
5. Tribunal members cannot be appointed by government
6. Election Commissioners cannot be appointed by government

Of course HC and SC judges are appointed exclusively by the judiciary itself.

In which other democracy is the appointing powers of a democratically elected government forced to be shared with unelected bodies like the judiciary or with people who lost the election (LOP).

What is the purpose of the elaborate election if the judiciary is then to say that the elected government cannot be trusted with appointments in high places hence others must also have a say. Does it remain a democracy where the will of the people, periodically expressed, is permanently circumscribed by an unelected body?

If a major law and order issue crops up, who is held responsible or accountable? The elected government or the CJI or the LOP? Yet, they both have role in the appointing process but no role in the accountability matrix!

An absurd result of these SC verdicts - the SC sits in judgement over the functions performed by the very people it chose to appoint ( CBI chief; CECs and ECs till new law came into effect).

On the converse, if one were to take the view the high office appointments must be made with greater consultation, then what about HC and SC judges?

If a SC judge can sit in appointment of CEC (as SC ruled) then why can't PM or LOP (for that matter) sit in appointment of a Judge?

However, when such logical questions are put to the SC where a reasoned response may not be plausible, the hammer of Article 142 or the conveniently flexible concept of 'Basic Structure' comes down!

So, the Executive Director of @IndianExpress doesn't even know that under Section 18 of the Chief Election Commissioner and Other Election Commissioners Act, 2023, the business of the Commission is to be transacted unanimously “as far as possible”. In case the three members differ, the matter is decided by majority. The ECI's own website also states that its multi-member Commission functions through majority decision-making, with all commissioners having an equal say.

CEC cannot supercedes other ECs as per constitution.

Ramnath Goenka would have slapped him twice for ignoring this critical fact. 🤦🏻‍♂️🤦🏻‍♂️

@arvindgunasekar ECI staff is provided by central govt. If there is any issue with working of staff particularly IAS officers, it is the responsibility of cabinet secretary, who appoints them in ECI to look into it.

@Shivam_h9 There are 2 issues mainly. Linking of form 6 with SIR new addition to rolls means not for existing voters. Other issue of software ECInet which appears tht EC failed to grasp. @IndianExpress is acting as if thy unearth some great irregularities whn it was usual business
