Breaking: A Kenyan court has ruled that the offence of "careless driving" no longer exists under current law.
In a landmark judgment, the High Court quashed the conviction of Daniel Mwangi Munyaka, ordered a refund of the KSh 200,000 fine he had paid, and declared the entire trial a nullity after finding he had been charged under an offence that was removed from the Traffic Act years ago.
The bigger question is this: if the law was amended in 2012, how many Kenyans have since been charged, convicted, fined, or coerced into paying penalties for an offence that no longer existed in law?
This is not just about one driver getting his money back. It raises serious concerns about prosecutions, charge sheets, legal oversight, and the administration of justice over the last decade.

Did you know that most marathoners were struggling on the other side past 30km? That's where most of your support needed to be. But instead your support was concentrated in the half marathon section. I remember helping a friend at 32 km, your ambulance were nowhere to be seen.
Apart from water that your support stations offered there are other things that count as support to runners like Coke, ORS and Salt.
Apart from the bananas you gave we needed Water Melons and Oranges.
By the way the water packaging was wasteful. A smaller package next time ...
For half marathoners they were lucky to not have a longer distance to suffer because tell me why one support station is 5km away from the other. At least a gap of 3km would have been better. Full marathoners had to pay the price past 35km when they needed support most!
There were fewer toilets than could serve participants from Uhuru Park the finish line. On the ExpressWay you find one toilet at the km 5 support station and the next one at km 18. So finding a line outside the only toilet in a support station was bad we had to pee on the side
Now lets get to the Race day where getting the luggage area was an issue, also the Uhuru Park was left open such that anyone would enter and leave at will without much scrutiny. Some people risked getting their items stolen.
Why would you have the section for t-shirt size if on th collection day they are given on a first-come, first served basis? In other marathons most of the time the eleventh hour registrations are the ones that don't guarantee someone to get their perfect size.
For the first time we saw a marathon where the starting time for the half marathon was going to be 2hrs 15 minutes after the full marathon. This even made people joke that the marathon participants were the only runners and the rest were just field officers.
When the registration slots were over one of your officials reportedly misinformed the public through a unclear communication channels that you could still show up and run even if you never registered. Later this statement was recanted when someone else tried to inquire about it.
From registration your site couldn't handle a lot of traffic especially when the eleventh hour approached. I am sure some people were unable to finish registration because of the outages on that site.
The complaints are many as to why many people struggled despite the months of preparation they had made for this particular day some elite some recreational runners. They will be dropping them under this thread shortly. Am calling upon all the stakeholders in this!
