Two disputes before the Delhi High Court have brought that question into focus.

Bombay Shaving Company’s Switch4 campaign challenged the convention around razor handles and blades. Beco’s campaign put the ingredients used in household products at the centre of its comparison with HUL.

The larger issue goes beyond either dispute: when comparative advertising claims to serve consumer choice, where does legitimate comparison end and unsupported implication begin?

OPEN examines what these cases reveal about competition, advertising claims and the line between making consumers notice a difference and giving them enough information to judge it.
