As an advocate, I have a genuine legal question regarding the Swatantra Bhardwaj case.

Under Section 34 of the Bharatiya Nyaya Sanhita (BNS), an act done in exercise of the right of private defence is not an offence. Sections 35–40 further define when and to what extent this right can be exercised.

So, if the factual defence is that the accused acted in lawful private defence, that defence necessarily requires examination before concluding criminal liability.

But here is the important legal question:

If the underlying act is ultimately found to be protected by lawful private defence, what is the legal basis for sustaining an offence under the SC/ST (Prevention of Atrocities) Act?

The SC/ST Act does not make every dispute or assault involving an SC/ST person automatically an offence under the Act. The specific ingredients of the relevant provision must be satisfied.

Therefore, the questions for investigation and ultimately the Court are:

What specific offence under Section 3 of the SC/ST Act is alleged?

What are the factual ingredients supporting that particular provision?

Was the alleged act committed with the requisite caste-related intent/knowledge, where required?

Was there an immediate threat giving rise to a lawful right of private defence?

Was the force used proportionate to the threat, or did it exceed the limits prescribed by law?

A claim of self-defence is not an automatic acquittal, but equally, registration/invocation of the SC/ST Act cannot substitute for proving the statutory ingredients of the offence.

And most importantly, for every citizen:

If you get into a physical dispute with anyone, including a person belonging to SC/ST, do not assume that you have no right to defend yourself. But do not use excessive force either.

Preserve CCTV/video evidence, identify independent witnesses, seek medical examination immediately if injured, make your own complaint/counter-complaint where legally warranted, and consult a criminal lawyer before making statements on social media.

Subject: Request for Inquiry Into Alleged Provocative Social-Media Content and Verification of the Age and Circumstances of the Person Operating the Account

Respected Sir/Madam,

I, Umang Sharma, General Janta Party (GJP), respectfully request Delhi Police to examine certain social-media content allegedly being published by a person using the name “Nishu Azad.”

Certain posts/videos attributed to this account have come to our attention which appear to contain derogatory, abusive and/or provocative references concerning Hindu deities, religious beliefs and cultural practices. Considering the reach of social media, we are concerned that such material may have the potential to provoke hostility, create unnecessary confrontation, or disturb public tranquillity.

We are not seeking to prejudge whether any criminal offence has been committed. We respectfully request the competent authority to independently examine the original content, its complete context, intent, circulation and surrounding circumstances and determine whether any provisions of the Bharatiya Nyaya Sanhita, 2023, Information Technology Act, 2000, or any other applicable law are attracted.

We have further been informed that the person concerned may be below 18 years of age. We are unable to independently verify this information. We therefore request Delhi Police to verify the person's age through appropriate lawful means.

If the person is found to be a minor, we specifically request that the matter be handled strictly in accordance with the Juvenile Justice (Care and Protection of Children) Act, 2015, and other applicable child-protection requirements, including protection of the child's identity, privacy, dignity and procedural rights.

Considering the possibility that a minor may be involved, we also request the authorities to ascertain:

1. Who actually owns, controls and operates the social-media account;
2. Whether the concerned content was independently created and published;
3. Whether any adult or other person is directing, encouraging, influencing or exploiting a minor to publish such content;
4. Whether any material has been edited, manipulated, impersonated or presented without its complete context; and
5. Whether the content, after examination in its complete context, constitutes any offence under applicable law.

This representation is not intended to target, threaten or encourage harassment of any individual, particularly someone who may be a minor. We seek only a fair, impartial and lawful inquiry by the competent authorities.

We are prepared to provide relevant URLs, screenshots, videos, dates, timestamps and other available digital material to assist the inquiry. We respectfully request Delhi Police to preserve relevant electronic evidence, examine the matter in accordance with law and take such action as may be legally warranted by its findings.

We have full faith in the due process of law and request that the matter be examined without prejudice to the rights of any person concerned.

Upper-caste Hindus still seem to believe that the BJP will eventually come to their rescue. That somewhere, somehow, help will arrive through the backdoor.

It won’t. And it hasn’t.

When it comes to political appeasement, the BJP will happily step on its own core voters if it thinks there is something to gain elsewhere.

The uncomfortable truth is that upper-caste Hindus are largely on their own. All we have is each other and a handful of voices like @ajeetbharti @neha_laldas @AbhinayWithYou @BhaiPreetSingh and lawyers willing to stand up when things go wrong.

So please understand the reality we are living in. Be careful about what you post, what you joke about and what you say. Because when trouble comes, don’t assume a political party or leader will rush in to save you.

For all the noise about “our core vote bank,” the message increasingly feels like this - your vote is guaranteed, so your concerns can wait. And that is exactly why we need to start standing up for ourselves.

Whatever is happening now and the way the SC-ST Act is being used is reducing that Act to a joke, which is a good thing. It has already lost its "charm". Hardly anyone is punished under it - just FIR and then quashed.

- जब निशु के पिता और स्वतंत्र दोनों ने एक दूसरे पर हमला किया तो FIR एक बाद गिरफ्तारी की बात सिर्फ एक की क्यों? निशु के पिता पर केस और गिरफ्तारी क्यों नहीं?

- निशु के हिंदू देवी देवताओं ऐप अभद्र टिप्पणी करते कई वीडियो वायरल हैं, फिर उस पर FIR क्यों नहीं?

- जून में हुए केस में एक वीडियो वायरल होने के बाद आख़िर करीब 3 महीने बाद ऐसे कार्रवाई की कोशिश क्यों?

- जब दोनों पक्षों ने ऐसे कृत्य किए हैं जो नहीं होना चाहिए फिर सिर्फ़ एक के ख़िलाफ़ माहौल क्यों?

- ये केस पूरे देश के लिए नजीर साबित होगा कि कैसे भीड़तंत्र के सामने प्रशासन घुटने टेकने पर मजबूर है
