It’s bad enough that the SEC brings charges before specifying that the activity in question is prohibited. But to refuse to specify even *after* bringing charges? In a Democratic society we don’t face penalties for rules that the rulers refuse to say are prohibited.
It’s surreal having a regulator on video shilling an unregistered security, then bringing charges against an exchange for listing that same asset. And then claiming it was clear it was an unregistered security…just not to the regulators until they decide to press charges. /1

I always found it weird that OHM seemed to lead majors through '21 (maybe still but vol is a lot lower now so its harder to tell)
I wrote it off bc how tf would it be? but maybe they all price risk and we just saw changes faster
