I expect there to be significant pushback on the applicability of this tax and whether it is actually enforceable, especially when considering state regulations and case precedent recognizing DFS as a game of skill and excluding it from gambling laws
I'm not sure the IRS intended to flip the entire daily fantasy sports industry on its head. Labeling entry fees as a "bet or wager" defeats the entire purpose of the fantasy sports exception (commonly applied to season-long and DFS) included in the UIGEA.
