Today in the House, a Congress leader made a personal remark against me, saying that when the Congress trapped me in a completely fabricated case and had me arrested, I did not resign. I want to remind Congress that I had resigned even before being arrested. I did not hold any constitutional position, even after being released on bail, until the court fully acquitted me.  The fake case against me was dismissed by the court with the clear observation that it was motivated by political vendetta.

The BJP and the NDA have always stood for moral values. Shri Lal Krishna Advani Ji too had resigned from his post merely on the basis of allegations. On the other hand, the Congress party continues to carry forward the unethical tradition started by Smt. Indira Gandhi.

The very same Shri Lalu Prasad Yadav Ji, to safeguard whom from the law the Congress party had once brought an ordinance, a move that was opposed by Shri Rahul Gandhi too—is being embraced by Rahul Gandhi at Gandhi Maidan in Patna today. The people clearly understand this double standard.

It was already made clear that this bill would be referred to the Joint Parliamentary Committee of Parliament for detailed discussion, yet the entire INDI Alliance, under Congress’s leadership, shamelessly united to oppose it in a disgraceful manner to shield corruption.

Today the Opposition stands completely exposed before the people.

On one hand, PM Shri @narendramodi Ji has introduced a constitutional amendment to bring himself into the ambit of law. On the other hand, under the leadership of Congress, the entire opposition has opposed it in order to remain above the law, run governments from jail, and cling to power.

The nation also remembers the time when, in this very august House, then Prime Minister Smt. Indira Gandhi Ji, through Constitutional Amendment No. 39, granted special privilege to the Prime Minister, ensuring that no legal action could be taken against her.

While the Congress’s work culture and policy have been to place the prime minister above the law through constitutional amendments, the BJP’s policy is to bring our own prime minister, ministers, and chief ministers under the ambit of law.

देश में राजनीतिक भ्रष्टाचार के विरुद्ध मोदी सरकार की प्रतिबद्धता और जनता के आक्रोश को देख कर आज मैंने संसद में लोकसभा अध्यक्ष जी की सहमति से संवैधानिक संशोधन बिल पेश किया, जिससे महत्त्वपूर्ण संवैधानिक पद, जैसे प्रधानमंत्री, मुख्यमंत्री, केंद्र और राज्य सरकार के मंत्री जेल में रहते हुए सरकार न चला पाएँ।

इस बिल का उद्देश्य सार्वजनिक जीवन में गिरते जा रहे नैतिकता के स्तर को ऊपर उठाना और राजनीति में शुचिता लाना है । इन तीनों बिल से जो कानून अस्तित्व में आएगा, वह यह है कि:

(1) कोई भी व्यक्ति गिरफ्तार होकर जेल से प्रधानमंत्री, मुख्यमंत्री , केन्द्र या राज्य सरकार के मंत्री के रूप में शासन नहीं चला सकता है।

(2) संविधान जब बना, तब हमारे संविधान निर्माताओं ने यह कल्पना भी नहीं की थी कि भविष्य में ऐसे राजनीतिक व्यक्ति भी आएँगे, जो अरेस्ट होने से पहले नैतिक मूल्यों पर इस्तीफा नहीं देंगे। विगत कुछ वर्षों में, देश में ऐसी आश्चर्यजनक स्थिति उत्पन्न हुई कि मुख्यमंत्री या मंत्री बिना इस्तीफा दिए जेल से अनैतिक रूप से सरकार चलाते रहे।

(3) इस बिल में आरोपित राजनेता को गिरफ़्तारी के 30 दिन के अंदर अदालत से जमानत लेने का प्रावधान भी दिया गया है। अगर वे 30 दिन में जमानत प्राप्त नहीं कर पाते हैं, तो 31वें दिन या तो केंद्र में प्रधानमंत्री और राज्यों में मुख्यमंत्री उन्हें पदों से हटाएँगे, अन्यथा वे स्वयं ही कानूनी रूप से कार्य करने के लिए अयोग्य हो जाएँगे। क़ानूनी प्रक्रिया के बाद ऐसे नेता को यदि जमानत मिलेगी, तब वे अपने पद पर पुनः आसीन हो सकते हैं।

अब देश की जनता को यह तय करना पड़ेगा कि क्या जेल में रहकर किसी मंत्री, मुख्यमंत्री या प्रधानमंत्री द्वारा सरकार चलाना उचित है?
