As a big brother to a college freshman, and being a fraternity alum myself - the Cornell news shocked me.
Then I read about voluntary intoxication loopholes in state laws, and decided to act.

@smi15913049@ScooterCasterNY The election and the bill they're trying to pass is definitely a good 90% why we're just now hearing about it. She's been on the board since 2021 just for being gov.

@ginabaninaa@BonnieS21912114@mooniegirl_ A bot would've done a better photoshop I made, had to make an account and tweet my youtuber then hopped off 😆 only came back to spread that website
@BartonBella1@lanechanged Advertising an incapacitated girl in a group chat of men with free 🐱, shop is open, come whip it out, is enough to know they knew what they were doing. Sorry to burst your bubble. Feel free to do research and learn about loopholes

@zosafinaa In the original phone call, Jane asked about 8-10 guys being in the room. I'm betting it's only 7 based off the evidence they have against them privately.

@PotatoDoggies "I have no idea how they [8-10 men] got there... There wasn't anything saying something was happening in that room"

Meanwhile in the group chat:
NBC News: within 15 minutes of the Cornell campus alert on the sexual assault in November 8, 2024, tips came on to the campus police:
* the names of men
* the existence of a GroupMe fraternity group chat where frat brothers were discussing what happened
* two women at the house that night said the fraternity brothers assured them the incident was consensual — and later asked one of them not to talk about it
* a screen recording of a Snapchat conversation among Chi Phi members from that night, where one advertised “free p----y” in an upstairs bedroom
* a caller said one of the men identified was her ex-boyfriend, and he told her that he “had attended a party at Chi Phi” where a woman had been “sexually assaulted by several males and coerced into consuming ketamine and other drugs.”
And more.
Much of the information was never passed on to the Tompkins County DA Office.
One day after a campus-wide alert notified students about a reported rape at a Cornell University fraternity in 2024, the school's police department received a tip from an anonymous caller saying that the Chi Phi's fraternity's leadership asked a potential witness to stay quiet because "the reputation of all involved and the frat would be ruined" if details of the incident spread across campus, according to the school records reviewed by ABC News. https://t.co/KuULkjqcXn
Don't take Groks word for it, research voluntary intoxication loopholes yourself and ask why 31 states don't have them.

State v. Khalil (MN 2021) ruled that "mentally incapacitated" required the intoxicant be given without consent, so voluntary intoxication did not qualify. The conviction was reversed and the law later amended to close the gap.
People v. Johnson (NY 2014) vacated a second-degree rape plea because the victim's voluntary drinking did not meet the statutory definition requiring a substance administered without consent.
Both show how these statutes create a voluntary intoxication loophole that blocks incapacity-based charges when the victim chose to drink.
