@nopestrathomas It’s pretty simple really. As an originalist and textualist, he just thinks Art. II an only be interpreted as a single (unitary) executive. Any fragmenting/insulating of the executive power from the single executive violates Art. II, no exceptions. (for him)
@nopestrathomas It’s also a bit pragmatic/practical. Case law has said that UET protects the separation of powers function, and executive agencies wouldn’t work too well if they also had to balance changing Congresses and not just administrations.
@nopestrathomas I wouldn’t go as far to say UET puts the executive above reproach, just says things that are executive need to answer to the executive and other branches shouldn’t meddle with decision making. Doesn’t prevent criticism/change post facto
@nopestrathomas I’m no originalist, but linguistically, “the” is usually used to denote singularity, and so the first sentence seems to imply a singular/cohesive executive power (personally I think the capitol ‘P’ helps too), and all that is vested in a POTUS.
