Another example of a man charged with first degree murder, accused of killing a woman while out on a previous criminal release. Toronto Police have also charged him with failing to comply with an undertaking. An undertaking is a legally binding promise made to the court or police requiring an accused person to obey specific release conditions while their criminal charges are before the courts. A charge of failing to comply alleges those conditions were breached. If these allegations are proven in court, this case will once again raise serious questions about release decisions. Protecting the public must remain the overriding consideration when determining whether an accused person should be released or detained. Every case must be assessed on its own facts, but when someone assessed as suitable for release is later accused of taking an innocent life, those decisions deserve careful re-examination.
