Last week, Senators Mark Kelly of Arizona and Mike Lee of Utah introduced the Critical Mineral Consistency Act of 2025, mirroring the Critical Minerals Consistency Act reintroduced in the U.S. House by Congressman Juan Ciscomani in Arizona and Congresswoman Susie Lee of Nevada.

This bipartisan effort displayed by Lee and Kelly is a crucial step toward strengthening domestic supply chains by eliminating bureaucratic inconsistencies that create uncertainty for critical mineral producers. By aligning the U.S. Department of Energy (DOE)’s Critical Materials List with the U.S. Geological Survey (USGS) Critical Minerals List, the legislation ensures that all essential resources—including copper—receive equal recognition and support for their role in national security, manufacturing, and energy independence.

For projects like Resolution Copper, NewRange Copper Nickel, and Twin Metals Minnesota LLC, this legislation provides a clearer and more predictable regulatory environment, allowing responsible domestic production to meet soaring demand. Copper and other critical minerals are the foundation of renewable energy technologies, defense systems, and advanced manufacturing. With global competition increasing, the U.S. must prioritize domestic production and reduce reliance on foreign supply chains.

By resolving inconsistencies in how critical materials are classified, this legislation will strengthen domestic supply chains, support American jobs, and bolster U.S. energy and manufacturing industries.
