Bomas Cannot Rewrite Your Vote: But is this Judgement Enough?

The High Court has made an important ruling about the 2027 presidential election. In simple words, the court said once a constituency announces and signs its presidential result, nobody at the county office or Bomas should change it. Not the IEBC Chairperson. Not a commissioner. Not an officer. Only a court can change it. That is the correct starting point because the vote does not belong to IEBC, politicians, courts or government. It belongs to the Mwananchi who wakes up, queues, votes and goes home hoping that their choice will be counted exactly as cast. A result from your polling station and constituency is the people’s instruction.

The Court says the National Tallying Centre is still legal. But it has placed a strict limit on it. IEBC may add up constituency results and check whether a candidate has met the constitutional threshold for President. It may not use “verification” as an excuse to correct, replace, cancel or secretly alter a constituency result. That distinction is important. “Tallying” should mean adding numbers. “Verifying” should mean checking whether the numbers being added are the same numbers already declared at the constituency. It must never mean inventing a new result in Nairobi. The national centre is supposed to be an adding machine and not a second election.

However, this judgment must also be criticised. The Court is right that the presidential election requires a national calculation. A President must win more than half of all votes cast and at least 25% of the votes in more than half of Kenya’s counties. That cannot be checked in one constituency. But this does not justify a vague or powerful national verification process. The National Tallying Centre should only answer two questions. First, do the national totals match the final constituency forms? Second, has any candidate reached the constitutional threshold? It should not become a place where officers make new judgments about which votes to accept, which figures to change or which results to ignore. Where there is a disagreement, the constituency form must win unless and until an election court orders otherwise.

The Court was too restrained on ballot reconciliation. The petitioners argued that before results are transmitted, IEBC should clearly account for every ballot paper. How many were issued, used, rejected, spoilt, unused or missing. The Court treated this as an administrative matter for IEBC and Parliament. That is understandable because courts should not run elections. But ballot reconciliation is not a small administrative detail. It is the audit trail of the vote. If nobody can explain where the ballots went, then nobody can confidently say the final figures are accurate. A transparent ballot-reconciliation framework would not interfere with IEBC’s independence but protect IEBC from suspicion and protect wananchi from fraud. It should be compulsory, public and available to agents before results leave the polling station.

The real test of this judgment will be whether the safeguards work on election night, under pressure, when the country is tense and every number matters. Kenyans do not need to be told to trust the process. They need a process that earns trust, one where every form is visible, every number can be checked, every discrepancy is explained, every commissioner sees the same evidence, every agent has access and no official can alter the will of the people in darkness. That is how the 2027 election can be lawful not only in court but also in the eyes of the mwananchi.
