Worse-1803🌠
Exactly 27 years after the birth of this nation Marbury VS Madison unleashed the courts as unelected arbiters of truth and justice forever creating a unlocked back door to our Republic.
America was the 1st member of the "27 Club"
Subsequent expansionist interpretations that broaden the Amendment to encompass sovereign citizens of other nations represent a classic bait & switch. Such inferences create the mere appearance of constitutional validity while enacting an illegal delegation of the social contract
The sole intent of 14th's citizenship clause was to grant legal personhood & sovereignty to former slaves, non-sovereign people previously treated as property.
Later expansionist inferences applying it to Foreign Sovereigns is classic bait-and-switch color of law. 🌠
@StephenM
Automatic birthright citizenship for children of foreign nationals (temporary or unlawful) constitutes an unconstitutional delegation of rights and protections reserved for those who inherit the contract by blood or adopt it through naturalization.
True delegation of American citizenship , & thus entry into the constitutional compact requires a legitimate, voluntary cession of prior sovereignty. Foreign sovereigns, regardless of geographic location, retain their allegiance unless they formally naturalize & oath of loyalty.
This limited application of jus soli served as a remedial mechanism to transition non-sovereign persons into the body politic. Never intended as a broad political doctrine supplanting the dominant Western tradition of jus sanguinis, which the Founders understood as central
The 14th Amendment’s citizenship clause was narrowly crafted to address a singular historical injustice: conferring legal personhood and sovereignty upon those previously held as chattel slaves , individuals who possessed neither sovereignty nor voluntary presence in the US.
@Tim418385956391 @theavrecord Yes , but that doesn't explain why they don't have discernable Siberian genes.
I mean Greenland to nova scotia is a small boat ride away but I don't see teachers claiming that Norse are indigenous to North America, Or are they?
@Michael951413 yup,
and lets not forget those aint Rights, those are privledges given to subjects
Civil Privledges ,not Rights.
Government doesn't bestow rights, they are supposed to simply protect them.
