Oggetto: Considerazioni sull'eventuale aumento della tassazione sulle cripto-attività.

In seguito alle recenti dichiarazioni riguardanti l'intenzione di aumentare la tassazione sulle criptovalute dal 26% al 42%, desidero esprimere alcune considerazioni in merito, anche alla luce della mia esperienza professionale nel settore.

Sono un appassionato e operatore del settore crypto, in qualità sia di investitore che di Dottore Commercialista, con un focus specifico sulla fiscalità delle criptovalute ed affini. Da tempo mi occupo di supportare i contribuenti nel rispetto delle normative fiscali relative a questo ambito in rapida evoluzione.

Il mondo delle criptovalute è altamente innovativo e rappresenta un’opportunità straordinaria per l’economia italiana, specialmente per le nuove generazioni e per chi, come me, ha scelto di specializzarsi in questo campo. Tuttavia, la mancanza di conoscenza e comprensione, sia da parte dei media che delle istituzioni, ha spesso associato in modo ingiustificato le criptovalute a truffe e pratiche illecite, quando in realtà esse rappresentano uno strumento trasparente e legittimo per numerosi contribuenti.

Questa mancanza di comprensione si è manifestata anche a livello normativo. La Legge di Bilancio 2023, sebbene abbia introdotto per la prima volta una regolamentazione ad hoc per le cripto-attività, presenta ancora numerose criticità che la rendono difficile, se non impossibile, da applicare correttamente in molte circostanze. Nonostante queste difficoltà, ho sempre incoraggiato i miei clienti e conoscenti a conformarsi alle norme, anche quando queste non esistevano, posto che prima del 2023 non v’era null’altro se non documenti di prassi dell’Agenzia delle Entrate.

Personalmente, sto dedicando gran parte della mia attività professionale allo studio e all'approfondimento della fiscalità delle cripto-attività, tanto che sono arrivato a costituire, insieme ai miei soci, una società che ha sviluppato un software chiamato Tatax. Questo strumento è stato creato per automatizzare e semplificare il processo di dichiarazione fiscale delle cripto-attività e il calcolo delle plusvalenze, aiutando i contribuenti a rispettare le normative vigenti con trasparenza.
Siamo orgogliosi di aver sviluppato una soluzione che permette agli utenti di adempiere agli obblighi fiscali in modo semplice e chiaro. Esistono molti contribuenti onesti che, pur non essendo felici di pagare le imposte (chi lo sarebbe?), sono disposti a farlo secondo le attuali aliquote del 26%. Tuttavia, l'eventuale aumento al 42% rischia di essere insostenibile e altamente penalizzante per il settore.

L’aliquota prospettata è spropositata, non trova riscontro in nessuna altra giurisdizione internazionale e rischierebbe di scoraggiare gli investimenti nel nostro Paese, spingendo molti operatori a cercare opportunità all’estero dove le normative fiscali sono più favorevoli. Inoltre, una tassazione eccessiva potrebbe incentivare fenomeni di evasione fiscale, vanificando così gli sforzi per regolamentare e normalizzare questo settore.

L'innalzamento dell’aliquota, oltre a destabilizzare un mercato ricco di opportunità per i giovani e per l’innovazione, potrebbe avere conseguenze negative per l’economia nazionale, nonché per l'attrattività dell'Italia come hub per l'industria delle cripto-attività.

Per queste ragioni, invito il Governo a riconsiderare questa proposta. Sarebbe opportuno avviare un dialogo costruttivo con gli operatori del settore, al fine di trovare un equilibrio tra l’esigenza di garantire un gettito fiscale adeguato e la necessità di sostenere lo sviluppo di un’industria emergente e promettente.

Concludo auspicando che l'eventuale aumento venga valutato con attenzione, tenendo conto delle implicazioni economiche e sociali che comporterebbe. Sono a disposizione per un confronto più approfondito e costruttivo, qualora fosse necessario.

Good morning friends ☕️, I really don't feel like having to do this, but my anger is so intense that it automatically makes my fingers type on this keyboard.

Today, I want to talk about my experience with the @MantaNetwork team and their support, as well as with @TokensoftInc .

It was November, and my friend @cryptodonald89 wrote to me because he had found a seller to make an OTC trade to buy $MANTA at $1.40.
The quantity of tokens on sale was quite significant, so he proposed we split the OTC 50/50.

A good deal in my opinion, since at that time $MANTA was already listed on some premarkets like @aevoxyz or @HyperliquidX , and it was thus shortable. You could practically short the perpetual and ensure a certain profit from the OTC.

The unlocking conditions for these tokens are the same as those for a sale made years ago on Tokensoft. 50% at TGE and the remainder with a 10% release each month.
Before proceeding, since, as mentioned, it was a significant amount and it involved locking up a lot of liquidity for a long time, I wanted to make sure that the sale was as safe as possible.

That's when I was aided by an OFFICIAL ANNOUNCEMENT from the Manta team, stating unequivocally that from January 10th onward, the address elected to receive these tokens could no longer be changed.

This means that by doing an OTC and entering my address, from January 10th onward, it could no longer be changed, and therefore the $MANTA in the respective unlocks would certainly arrive at the address entered by me and Donald.

It's here where the problems started.
January 10th passes, but we notice that the address can still be changed. We point this out and the Manta team responds again that after checking, it is only a UI/FRONT END issue, but in reality, the address cannot truly be changed.

Seeing thus two announcements, made by the official team, which, I remind you, is a project with a market capitalization of $3.7B and a TVL of $700M, I finally feel reassured.
The day of the TGE, January 18th, arrives, 50% of our deal is unlocked, we receive it, I decide to hold it and stake it on their validator node.

Another month passes, February 18th, and problems begin, an odyssey that still has no end in sight.

We were supposed to receive another 10% of our tokens, but these tokens do not arrive. No one can give us an explanation, and initially, I think it was our own problem. 🤷‍♂️
But then, in the discord, panic sets in, many users were in the same situation as us and we were asked to open tickets on discord.

Keeping calm and following all the rules, we open the tickets, which to this day, after a full 24 days, have had no response, no news, or at least an update. Nothing at all. I attach photos that speak for themselves.

But what makes me angriest is their total disregard, arrogance, superficiality, and annoyance with which they handle the issue.

I am tired of seeing highly paid people treat their community this way, and I think it's right to bring to light what is happening, both to help all the other people who are invested in this problem and to expose to as many people as possible how a huge project like Manta manages such issues concerning its retail investors.
I am really very, very disappointed and amazed at how I can still have hope in this environment after all these years here.
I shouldn't be surprised by these things.

Today, after 4 months of tickets(All Tickets close whitout resolve), discussions, messages, and whatnot, the situation is this:

Plus, on February 18 $MANTA was worth $3.10, while today it is 50% less. 📉
I did not only lose a lot of time chasing them to fix this issue and keeping a substancial amount of liquidity locked, I suffered a significant loss as well, seeing my profit fade as MANTA's price plummeted.
