SB 331 (Menjivar) is NOT what Californians need! This bill, authored by State Senator Caroline Menjivar, allows for the forced institutionalization of individuals with ANYTHING listed in the DSM-5 (including caffeine withdrawal, gender dysphoria, or restless leg syndrome) and are deemed a threat to themselves or others. This dangerously broadens language that permits those who will enforce this law to further target individuals experiencing homelessness, transgender individuals, people of color, women, and more marginalized groups. It gives massive clearance to law enforcement to essentially kidnap anyone off the street based on perceptions alone.
This bill's harm goes hand-in-hand with CARE court, a system in which people are forced or coerced into treatment to avoid potential criminal penalties. These awful bills do not expand essential health services people desperately need, instead forcing them into treatment in facilities that already face limited services and staff. This is an egregious misuse of tax payer dollars that could instead be used to address root problems of health care access, expansive services, housing, safety, and more.
DRC stands for mental health care services that provide autonomy, self-determination, peer support, and well-being for our community. SB 331 provides greater freedom for law enforcement and the criminal legal system to penalize and lock up Californians without cause. SB 311 must die.

Medicaid “work requirements” is a catchall phrase for a variety of ways to qualify: work, schooling, caregiving, community service, addiction, and disability. In polls, the majority of Americans support this concept. The challenge isn’t the concept—it’s the implementation.
The bill would require states to verify eligibility of every Medicaid recipient every 6 months. There is no way to do this in a cost-effective manner with any integrity. The state capacity to do this does not exist.
The result will be a flood of false positives and false negatives. People who should qualify will be excluded because they can’t navigate a burdensome process. Meanwhile, others who don’t meet the criteria but have more time or savvy will game the system, submitting unverifiable information that states are unlikely to audit.
Instead of qualifying people based on a broad definition of work, the system will grant Medicaid eligibility to those with the time and ability to navigate the administrative system. Regardless of one's view of the concept, implementation challenges make this impossible to carry out.
