The Grayscale team and our legal advisors are actively reviewing the details outlined in the Court’s opinion and will be pursuing next steps with the SEC. The SEC is getting battered in the court. In our case it's been proven wrong, been called hypocritical, lacking faithful allegiance to the law, fined for discovery abuses and now another distinguished court saying it’s "arbitrary and capricious" - that’s a really big deal.

We oppose the SEC’s request for an interlocutory appeal. There is no extraordinary circumstance here that would justify departing from the rule requiring all issues as to all parties to be resolved before an appeal.

The 5 Commissioners are political appointees thus, by definition, are political. @GaryGensler is a lifelong Democrat and Chair of the @CFTC under Obama, with both parties agreeing that he did a lousy job - just think MF Global. Of course, he served as Hilary Clinton’s CFO for her 2016 presidential campaign. Gensler literally signed and/or approved the check for the Steele dossier. No one can credibly claim that Gensler’s tenure at the SEC is not 💯 politically-driven. Let’s not forget he had two personal meetings with @SBF_FTX. I’m sure SBFraud’s political contributions played no role is obtaining access.

🚨EXTRA clarification: This trial will decide some disputed facts that Judge Torres did not rule on in summary judgment.
The jury will only be debating whether or not @bgarlinghouse and @chrislarsensf aided and abetted @Ripple in selling unregistered securities.
Torres's summary judgment decision still stands and has not been appealed by the SEC at this time.
