This peaceful rally by Biafrans on the 20th of January 2026 reminds us of the sad day when innocent Biafran protesters were massacred by the APC regime for showing solidarity to @realDonaldTrump.

The Nigerian constitution by implication allows Biafrans or any cohesive group or aggrieved Nigerians to seek self Determination and autonomy as a people .

This law is specifically provided under articles 1 &20 of the African chapter on Human and peoples Rights, ratified by and domesticated by Nigeria in 1983 at CAP A9, Laws of Federation Nigeria,2004.

Articles 1 and 20 of the African Charter on Human and Peoples' Rights establish core principles: Article 1 commits State Parties (like Nigeria) to recognize, promote, and protect human and peoples' rights, ensuring legal effect for the Charter in national law (as done via Nigeria's 1983 Act, Cap A9 LFN 2004).

Article 20 guarantees the right to self-determination and free disposal of natural resources for all peoples, allowing liberation struggles against foreign domination and affirming peoples' control over their wealth.

Article 1: General Principles (Duty to Recognize & Protect)

* Nigerian State must recognize the rights in the Charter, ensure their protection, and give them legal force within their domestic laws.

* Nigeria's Implementation: Nigeria ratified the Charter in 1983, and the African Charter on Human and Peoples' Rights (Ratification and Enforcement) Act (Cap A9, Laws of Federation Nigeria, 2004) makes its provisions directly applicable in Nigeria.

Article 20: Right to Self-Determination & Resources

* Self-Determination: All peoples have an inalienable right to determine their political status and pursue economic/social development freely.

* Anti-Colonial Struggle: Colonized or oppressed peoples can use any means recognized by the international community to achieve liberation.

* Resource Control: All peoples have the right to freely dispose of their wealth and natural resources in their own interest.

* State Duty: Nigeria and other State Parties must work to eliminate foreign exploitation of resources to benefit their peoples.

In essence, these articles mean Nigeria has a legal obligation, stemming from its ratification, to uphold the Charter's rights, ensuring that its laws and actions respect self-determination and the control of natural resources by its peoples.
