๐งต Exposed: The "H-1B visa to B-2 visa Pivot." How a massive immigration loophole allows laid-off H-1B workers to stay in the U.S. indefinitely while avoiding a $100k fee. ๐๐บ๐ธ
1/ The Loophole starts: โณ When an H-1B worker is laid off, they have a 60-day grace period to find another job or leave the country. Instead of leaving, many file to change status to a B-2 "visitor" visaโa tactical move to freeze their departure clock.
2/ The "Tourist" Mask: ๐ญ Under the B-2, they get up to 6 months (on top of the 2-month grace period for H-1B visa holder) to "tour" while actually aggressively job hunting. While they can't work, they are permitted to interview, allowing them to maintain a local presence that American tech companies favor.
They also utilize this time to learn new skills or technologies that be embellished with fake experience on their resumes.
3/ Avoiding the $100k Tariff: ๐ฐ This move is a massive financial dodge. A Sept 2025 Presidential Proclamation hit new H-1B entries with a $100,000 "tariff on imported labor"; however, because the B-2 flip is an in-country "Change of Status" (COS), it is explicitly exempt from the fee.
4/ The "Flip": ๐ Once a new sponsor is found, the employer files an H-1B transfer via COS. USCIS approves this as an internal adjustment, allowing the worker to return to H-1B status without ever leaving the country or undergoing consular processing abroad.
5/ Backup of backup: ๐ If these former H-1B visa holders are still unable to land a job after 8 months, they then apply to shady universities or Day 1 CPT schools (with a 100% acceptance rate) to secure a F1 visa, while continuing to stay in the US. The key point being that a lot of these folks are not leaving the country and are continuing to clog the labor markets.

All the Supreme Court Justices who opposed President Trump's legal team's requests to review the alleged voter fraud back in 2020, for lack of standing or some other made up excuse, need to resign in disgrace. Otherwise they need to be impeached. All of these violations were known back in 2020. It's the Supreme Court's responsibility to protect our 1st Amendment rights.

These folks have started scamming the O-1A visas too. A lot of immigration firms have set up shop who are targeting visa holders on how to game the system to secure an O1 visa. Miraculously, everyone is now an AI/ML Expert, publishing some ghost technical papers in unknown journals and then applying for this visa.
It's going to be an herculean task because Big Tech, management consulting companies, outsourcing companies, medical, universities and other industries have Congressional members and regulatory agencies in their pockets. The program cannot be scrapped or tightened w/o Congressional approval. Regulators are told to look away in exchange for cushy jobs in the industry after they retire from these governmental agencies.

After โstudiesโ, 90% join fake consultancies run by Telugu owners. These fake consultancies have offices in Hyderabad and America.
They hire people with basic English skills in Hyderabad to work US night shifts. They create fake resumes and apply for contract jobs on US job sites (Dice, etc.).
Example: $100/hr job โ consultancy says โwe got only $70/hrโ. Out of that $70, they split 70/30. Student gets $49, owner gets $21/hr plus the initial markup 30, total 51โ for doing nothing.
Each fake consultancy has 100 to 10,000 students. Imagine how much they are earning without doing anything.

How they get jobs:
Someone in India submits fake resumes. Once selected, a proxy interview (another person clears it). The fake candidate joins.
Because of remote work flexibility, fake candidates take 2โ4 jobs. Real work is done from India for $600/month. The fake student earns big, the consultancy owner earns big, the person in India earns little.
Americans lose jobs, families go into trauma.

Once these fake students get H1B, the fake consultancy files for a green card after 5 years. He brings an uneducated wife on H4 EAD. She opens an LLC with fake degrees and starts the same cycle.
Children get automatic US citizenship (birthright), free schools, government benefits.
Parents on B1/B2 (10โyear tourist visa) stay 6 months here, 6 months there โ cleaning, cooking, babysitting while the couple works multiple jobs.

This a loophole and fraud perpetuated even by the MAGA/FAANG companies. If their OPT employees aren't able to secure an H-1B visa after 3 attempts, they send these employees to an office abroad and bring them back after a year on a L1 visa. FYI - Green Cards for L1 visa holders are approved within 6 months, irrespective of country of origin.
