EACC RECOVERS GRABBED PUBLIC LAND VALUED AT KES. 45 MILLION IN KAREN, NAIROBI

The Ethics and Anti-Corruption Commission (EACC) has recovered a prime parcel of land along Mukoma Road in Karen within Nairobi, valued at approximately KES. 45 Million, grabbed by private individuals.
The recovered property known as L.R. 2270/71 measuring 0.029 hectares, was surrendered to the Government of Kenya in 1994 for the purpose of public utilities and the construction of a public access road. However, two years later, the property was unlawfully allocated to private individuals.
In a judgment delivered by Hon. Lady Justice Lucy Mbugua, the Court found that the property is public land and that the purported transfer to private persons was illegal, unlawful, fraudulent and corrupt hence a nullity. The Court further ordered cancellation of the title and directed the same be registered in the name of the Nairobi City County Government as a public utility plot.
The Commission welcomes the decision of the Court and reaffirms its commitment to recover corruptly acquired assets.

Parliament "Kills" the Conflict of Interest Bill Initiated to Tame Runaway Graft

The fight against corruption in Kenya suffered a major setback this week following Parliament's reversal on the enactment of the Conflict of Interest Bill, a critical piece of legislation introduced by the Cabinet in 2023 aimed at curbing the rampant embezzlement of public funds by state officials engaged in direct or indirect business dealings with the government.

In a move experts are calling dangerous, the Senate of the Republic of Kenya unanimously decided (25 to 0) to drastically alter the Conflict of Interest Bill by:

1. Deleting Sanction Provisions: The Senate removed sections that imposed sanctions for conflicts of interest within the Bill and other existing laws such as the Anti-Corruption and Economic Crimes Act, 2003. This effectively eliminates any punishment for state officials conducting business with the government or awarding tenders to relatives.

2. Removing EACC as Implementing Agency: The Senate also stripped the Ethics and Anti-Corruption Commission (EACC) of its role as the implementing agency, instead assigning this responsibility to public entities.

This means officials will be tasked with investigating themselves for conflicts of interest, contrary to Article 79 of the Constitution, which establishes the EACC for such responsibilities.

Experts note that the legal provisions in existing laws slated for deletion by the Senate are currently fundamental for investigating and prosecuting individuals embezzling public funds.

For instance, many governors presently facing court charges are accused of conflict of interest and are charged alongside family members.

The Senate has heavily amended the bill and has now returned it to the National Assembly for concurrence and subsequent transmission to the President for assent.

The original Bill, approved by the Cabinet in early 2023, was forwarded to the National Assembly for enactment into law as part of the conditions imposed on Kenya by development partners such as the IMF.
