From speaking to a few legal people etc re Balogun, there's a consensus that:
10.5 is clear - cards are issued by the referee. They are not "disciplinary measures" so 12.7 should not apply
The object of the FIFA disciplinary code it is to do with infringement of rules, not on-field offences
9.1 says decisions are final and may not be reviewed by the FIFA judicial bodies

@tuhlyjzelud@EricLDaugh@ClayTravis Listen, the real scandal here isn’t necessarily the “is it a Red Card or not?”, the real scandal is FIFA / Infantino suspending the red card for a year rather than rescinding it. That is absolutely astonishing, and sets a dangerous precedent in football.

The referee (and VAR) only need to conclude that the challenge endangered the opponent’s safety or involved excessive force for a red card to be justified.

* Did it endanger opponent’s safety
* force used
* speed & intensity

USA striker Folarin Balogun committed this outrageous foul against Bosnia and was shown a straight red card… but here’s where it gets crazy.
The White House publicly contacted FIFA and the tournament organizers, asking them to lift his suspension. And they actually did. Balogun is now eligible to play against Belgium.
The organizers cited something called a “probation period,” meaning the red card still stands, but instead of serving the mandatory suspension, he’ll only be punished if he commits a similar offense again.
A blatant manipulation of the rules for everyone to see, especially considering red-card suspensions are not supposed to be appealable.
