I'm a linguist, not a lawyer, so I've no idea what the courts will make of the merits of this pre-trial application. But if it fails, and the matter goes to a full hearing, the case will certainly be one to watch. And Senator Craughwell will have done the public some service.

This is only about saving face. No credible case can be made that the examination by a court of an alleged defence agreement, the broad scope of which is already public knowledge, presents any such threat. The State cannot expect the courts to take such a claim at face value.
