@AriPeskoe@Meeenurz@matthewstoller I think independently of the legal question, there will be a big political legitimacy problem for the SCC if she doesn’t recuse. That would probably be true regardless of her prior comments at confirmation, but they don’t help matters.
@AriPeskoe@Meeenurz@matthewstoller Of course, there's nothing binding about her email at the time or whatever she told state senators privately. The idea she would have pledged to recuse from a single transmission line proceeding involving NEE, but not an acquisition by NEE, would be absurd on its face.
@AriPeskoe@Meeenurz@matthewstoller Yes. Though as is common in these situations, that's a bit of a different description from Bagot in her email than the various senators' interpretation of it from the time.
