▪In Ajay Rajendra Khare vs. The State of Maharashtra, Bombay HC quashed criminal proceedings initiated against the husband, his parents, sister, and brother-in-law U/S 498A, 323, 504, 506 r/w 34 IPC.

▪Court strongly criticized the prejudiced and perfunctory approach of the police, emphasising that allegations of cruelty must be carefully scrutinized, especially when the facts indicate possible misuse of legal provisions.

▪Court observed, “Nowadays, even the police are not taking proper precautions and conducting appropriate investigations when it comes to offences under Section 498A IPC. This offence is now taken casually by the police, who often act under presumptions while dealing with FIRs. This is one such example of misuse.”

▪The couple got married on 28.01.2024. FIR alleged that within 2 months, the wife was driven out of her matrimonial home. The husband submitted that the wife had resided with him for only about 40 days and had suppressed her professional status as a medical practitioner employed as a Senior Executive in MD India Health Insurance TPA Pvt. Ltd., falsely portraying herself as a housewife.

▪Court noted this suppression and stated, "She has stated her occupation as household, which means she tried to project that she is not employed. Even in the statements of witnesses, her occupation is silent or not disclosed."

▪She further alleged that within just two days of the marriage, the mother-in-law demanded ₹20,00,000 as dowry. Court remarked, “It is hard to believe that within those two days, the sister-in-law started saying that the informant should be killed by pressing a pillow on her face and that applicant No.1’s second marriage should be performed.”

▪Court also found the witness statements of the wife’s family to be “copy-paste” and criticised the investigating officer for not even visiting the alleged places of incident or making inquiries with the neighbours.

▪The applicant also produced an RTI reply, which confirmed that the wife had initially refused to file a complaint and later changed her mind only after her father’s arrival.

▪Therefore, Court quashed the FIR and entire criminal proceedings against all the applicants.
