The Petroleum Industry Act (PIA) was signed into law on August 16, 2021 by President Buhari. The PIA aimed to fully commercialise Nigeria oil sector and to completely replace the old 1969 Petroleum Act.
Section 205 of the PIA mandates that the prices of petroleum products must be entirely regulated by free market forces of supply and demand.
By law, PIA took away the governmentโs power to fix retail pump prices or absorb under-recovery costs.
Despite the law being signed in 2021, the Buhari government bypassed immediate implementation for almost 2 years because of pressure from the labour unions and the oil cabals.
To fund this delay, trillions of naira were allocated in the 2022 and 2023 Appropriation Acts (National Budgets).
Operationally, the NNPC acted as the sole importer, absorbing the price difference directly from oil revenues and was not remitting to the federation account (FAAC).
President Buhari signed the 2023 budget in January 2023. In line with the 18 months extension of the PIA implementation . The budget did not provide for a full year fuel subsidy funding. The budget only made provision for subsidy from January till June.
President Tinubu inherited a budget already designed around termination of subsidy by mid 2023. The budget had already stopped providing for subsidy.
President Tinubu May 29 was just the announcement and not the removal.
