Dear District Attorney Spitzer,

We are writing as people who are done watching animal cruelty get processed like a nuisance. The facts in the Hahn Nguyen case are already public. Santa Ana police arrested her. The video is public. The plate reader is public. She admitted the dog was hers. This letter is not here to re-investigate. It is here about punishment.

She is 75. That is not a defense. Age does not wipe the act. Age does not earn her a quiet exit. And age does not mean a mental institution instead of a courtroom. Do not park this in a hospital and call it resolved. Do not cite her out and call it accountability. She is competent enough to drive, to plan, and to leave. She is competent enough to be charged.

Penal Code 597(a) is a wobbler. Filing it as a misdemeanor is a discount, and this county should be ashamed if that is the landing spot. File the felony. Ask for the ceiling: 3 years, the $20,000 fine, no probation, and a permanent ban on owning, keeping, or residing with animals. She should not be home tonight as the outcome of this case. Home is not a sentence.

Animal lovers in Orange County are outraged because we have seen this pattern. A dead puppy, a statement, a booking, then a release, then a plea that treats the animal as property with a pulse. Blackey was baited and killed. If your Animal Cruelty Unit means what your office says in public, this is the file where you prove it.

Maximum term. Maximum fine. No soft landing. No age excuse. No institution instead of court.
