The Department of Justice has issued an opinion to the Equal Employment Opportunity Commission (“EEOC”) that its guidelines about disparate-impact liability under Title VII of the Civil Rights Act are unconstitutional. The Office of Legal Counsel found that EEOC’s guidelines pressured employers to engage in racial discrimination.
"Despite trying to promote equality, EEOC's disparate impact liability interpretation under Title VII actually fosters the very discrimination its guidelines seek to address," said Acting Attorney General @DAGToddBlanche. "This opinion will now allow businesses to hire based on performance, restoring equal opportunities in the American workplace."

That’s why we opened an investigation into Diversity Lab, a for-profit DEI “consultancy” that partnered with over 300 law firms to impose race- and sex-based quotas in their hiring, promotion, and leadership decisions. Because such agreements to rig labor markets through quotas can violate the antitrust laws, the FTC investigated Diversity Labs. Rather than comply with the antitrust laws, Diversity Lab is shutting its doors.

BREAKING: The @USEEOC is suing The New York Times Over DEI-Related Race and Sex Discrimination
The lawsuit alleges unlawful discrimination in a promotion decision based on race and/or sex. According to the suit:
• A qualified white male employee was excluded from final interviews
• All finalists selected were not white males
• The role went to an external candidate with less relevant experience, despite experience being a requirement for the position

Today, Acting Attorney General Todd Blanche announced the first False Claims Act resolution secured under the Civil Rights Fraud Initiative, which he launched in May 2025.
“Racial discrimination is illegal, and government contractors cannot evade the law by repackaging it as DEI,” said Acting Attorney General Todd Blanche. “The Department launched the Civil Rights Fraud Initiative to root out this misconduct, hold offenders accountable, and end this practice for good.”
