The legal term is Post Hoc Rationalization also called “shifting justification” in administrative law.
It means an institution makes a decision, then adds new justifications afterward to defend it. Courts treat this as evidence of bad faith because it suggests the original reason was insufficient.
The specific doctrine is the Chenery Principle (SEC v. Chenery Corp, 1943): an institution must stand or fall on the reasons it gave at the time of its decision. No reasons added later.
Applied to @IntersectMBO:
🏴 Statement 1: May 8th, suspended 160+ members on four grounds. KYC failures were not among them.
🏴 Statement 2: May 15th, introduced KYC failures as a significant justification for the same suspension already executed.
That new reason cannot legally strengthen the original decision.
Under Wyoming Statute § 17-19-621, suspension must be carried out in good faith. A shifting justification is not good faith.
Under Article 2.8 of your own Bylaws, stated cause must precede suspension not follow it seven days later.
🏳️ 160+ members would be completing their questionnaires honestly before June 2nd.
We ask only that the process reviewing them meets the same standard of consistency the law requires.

He is a very vibrant community leader, I personally voted him because of his capacity, I was shocked when out votes was removed and our accounts was suspended.

Not before the election opened.
Not before the voting window.
Not before results were published.
After. All of it. After.
These members completed KYC. Paid their fees. Voted within the official window. Watched their votes get removed on results day. Received a generic rejection email. And are now hours later, receiving a suspension notice with no reason, no evidence, and a single line directing them to an email address.
This is not a suspension process. This is damage control dressed up as administration. @LallyMcClay@br1_lorenzo@IntersectMBO
A legitimate suspension, one with any legal or procedural standing happens before participation is revoked. Not after. You do not let someone complete KYC, pay their membership, contest an election, cast their votes, and then suspend them retroactively once the results are inconvenient 👀.
That is not governance. That is not due process. That is not what a Membership Based Organisation looks like.
The email does not state why.
It does not cite which membership term was violated.
It does not provide evidence.
It does not offer a right of appeal.
It does not acknowledge that these members voted before any suspension was communicated.
It just says “your membership has been suspended” and points to an email address.
So let me ask plainly:
1. On what specific ground was each account suspended?
2. When exactly was the decision to suspend made, before or after votes were cast?
3. Who made that decision and under what authority?
4. Why were members not notified before their votes were removed?
5. Where is the right of appeal?
These are not aggressive questions. They are the minimum standard of due process that any membership organisation decentralised or otherwise owes to its paying members.
@IntersectMBO built this organisation on the promise that governance would be transparent, fair, and community led.
This email is none of those things.
We are documenting everything. Every email. Every timestamp. Every unanswered question.
The audit better be thorough. Because the community is conducting one of its own. 🔱
