WHY THE TN GOVERNOR MAY NOT BE WRONG

The TVK wanting Joseph Vijay to be sworn in as Tamil Nadu CM immediately, without demonstrating proof of numbers, and the Congress building a deliberate narrative around it reminds me of what the GOP did in Karnataka, in May 2018.

On 19 May 2018, BS Yediyurappa resigned as the CM two days after being sworn in, failing to secure a majority ahead of a SC-ordered floor test. BJP had emerged as the single largest party with 104 seats in the 222-member assembly election (excluding two seats where elections were deferred). However, they fell short of the 112-seat majority mark.

An unprecedented pre-dawn hearing was held in the Supreme Court and Abhishek Manu Singhvi argued the case for the Congress. While the apex court refused to stay the swearing-in, it questioned the numbers and asked how the BJP, with 104 seats, could claim a majority when the rival alliance had signed certificates for 117 members. It ordered an immediate floor test and BSY lost. The court overruled the Governor’s 15-day deadline to prove majority, which could have led to horse-trading. The phrase ‘Operation Lotus’ and resort stays were well known in Karnataka by then.

Therefore, what is wrong if the TN Governor is being cautious? To ascertain numbers is essential to ensure that the new government does not fall within days, and also be correct if the matter ends up in court.

Given the Karnataka precedent can the Congress again send Singhvi to argue in the SC pre-dawn or post-dawn. His own earlier argument may go against him.

Why is the Congress with five seats so enthusiastic? They may get one cabinet berth at best. Is it to save themselves from the ‘backstabbers’ narrative that is deepening in TN?
