All immigrants in the US on temporary visas, students, H-1B workers, tourists and more, who want to apply for a green card must now leave the US
New numbers show this effects 780,000+ immigrants in the country
Exceptions exist for “extraordinary circumstances,” certain dual-intent visas, or specific categories, but the default is now return home
Here’s the reasoning
USCIS frames this as returning to the “original intent” of immigration law. Temporary visas are for temporary stays, they were never meant as a backdoor to permanent residency
People have been coming over to America, bringing their entire families and then waiting on Visas, that all ends
Here’s who it effects most
- People on nonimmigrant visas (H-1B workers, F-1 students changing status, K-1 fiancés and more
- Family-based applicants already in the US
- Employment-based
But it’s not everyone
Immediate relatives of US citizens can be an exception. But this ends an immigrant getting a visa, bringing over their whole family and drawing out visa processes for years
Most Americans I think right now would be more happy with zero immigration going forward but this is a good step. Remove them all
