In February 2026, Lord Lake ruled that "viewed objectively there were no reasonable or probable grounds for bringing the prosecution against" me in 2020.
He also ruled my rights to a fair hearing had been violated under ECHR due the immunity of the Lord Advocate. That immunity renders Scots law incompatible with the European Convention for Human Rights.
Lord Lake makes plain in his February 2026 judgement in my case that both Police and @copfs had "ulterior motive for prosecution" and this itself was indicative of malice.
Although his judgement effectively ended my claim against the Lord Advocate, incredibly she appealed the decision not least because the decision, as it stands, will mean a new Criminal Justice Act will be required to make Scots law compatible with ECHR and strip the Lord Advocate of their absolute immunity.
It also opens up the entire criminal justice system to reform and evidently that is unconscionable for the head of Scotland's prosecution service.
Not just my case, but in many other examples, it is painfully clear the Crown Office and Procurator Fiscals service needs major reform, not just in terms of process but prevailing culture.
To a large extent that will also require political will from the Scottish Government and Parliament... So I remain the eternal pessimist on that front.
I hope the judgement will go some way towards dragging Scotland's prosecutor into the 21st century and remove an internal culture so blatantly tainted by political bias and way too close to Government.
