Erias Lukwago is not charged with treason. He is charged with misprision of treason — knowing of a treason and failing to report it. The State alleges that he knew that Dr. Kizza Besigye & others intended to commit treason, and neither reported them nor sought to stop them.

On 23 June 2026, the Makindye Chief Magistrate, Her Worship Sarah Anne Basemera, denied him bail on a single premise — that his release might compromise investigations. The court found his three sureties, all sitting Members of Parliament, substantial. It confirmed his fixed abode at Wakaliga. It accepted his documented illnesses. It made, in terms, “no finding whatsoever” that he had interfered, or intended to interfere, with anyone. Having cleared him on every point that ordinarily decides a bail application, it sent a visibly frail man back to Luzira — because investigations remain “ongoing and incomplete”, and a man of his influence might, at some future date, affect them.

That reason does not survive contact with the facts. It melts beside the fire of logic.
There are no ongoing investigations. The State says so itself, on the record of the High Court. It completed its treason investigations in May 2025. It committed the accused for trial in May 2025. It filed an amended indictment on 30 December 2025. It made full disclosure by 2 June 2026. It has pronounced itself ready to call witnesses, two of whom it claims stood waiting in court on 11 June 2026.

The treason Lukwago is charged with failing to report has therefore been investigated, indicted, disclosed, and now stands for trial before Justice Emmanuel Baguma. It is not a mystery the police are still unravelling. One cannot close an investigation, indict upon it, surrender one’s evidence and declare oneself ready to lead it before one judge — and in the same breath tell another court that one is still investigating whether a citizen ought to have reported it.

A gravely ill man belongs at home. In the High Court the DPP says the investigations are finished; in the Magistrate’s Court, unfinished. That is not prosecution. It is persecution.

As for “influence”: treating a lifetime of lawful public service — Senior Advocate, former Lord Mayor, chairman of the PFF — as a ground for fear inverts the presumption of innocence guaranteed by Article 28(3)(a) of the 1995 Constitution. The magistrate conceded that such distinction “should never be treated as grounds for punishment or discrimination”, then did precisely that.

Nor was Lukwago a bystander to the Besigye trial. He was one of its defence advocates. Soldiers seized him from his home in the early hours of 15 June 2026, days before he was due in court for the defence. Gen. Muhoozi Kainerugaba publicly celebrated the abduction. The DPP charged him on 17 June 2026, after days of incommunicado detention. The mention of his case was fixed for 30 June 2026 — the very day the Besigye trial was to resume. The plain purpose and effect has been to remove Besigye’s advocate from the courtroom, and keep him out of it.

Strip away “national security” and “ongoing investigations”, and what remains is stark. A gravely ill man, whose specialists have recommended treatment abroad, sits in prison for failing to report a plot the State has already finished investigating and placed on trial — on the reasoning that it has not finished investigating it.

Courts and prosecutors should not play with a man’s precarious life. Luzira will not make him better, and the reason advanced for keeping him there is untrue. Uganda bleeds under the weight of impunity.

Lukwago should be free — not as an act of mercy, but as a matter of law and logic.

After seeing the photo of NMG’s new owners meeting Gen Muhoozi Kainerugaba, accompanied by Andrew Mwenda, and reading his tweet about the closure of NMG by his friend and boss, I revisited his 2007 resignation letter from Monitor Publications.

In one of the paragraphs in the letter, Mwenda wrote;
“I have been informed by journalists and editors that they are not allowed to write stories critical of the president and his family. The air in the editorial rooms is suffocating. I hold the values of independence from the state so dearly that I cannot work in such an environment”.

That Mwenda is now the one brokering meetings to force NMG to sacrifice its editorial independence and integrity to the State is simply unfathomable.

In the same letter, Mwenda implored Conrad Nkutu, the then managing director of the Monitor Publications, to consider his own position at the media house.

He wrote;
“As you take on this challenging job, I would advise you to seriously consider your own position at Monitor. You are a highly respected journalist with international credibility. It will be tragic if you go down in history as the man who presided over the adulteration of an independent newspaper in Uganda that was setting an example for the rest of Africa. It will also be tragic when you fall like many other Africans, especially the politicians, who have sacrificed the future of this continent at the Alter of a job”.
