These proposals are wholly illegal, unlawful, immoral and unethical and unconstitutional - they breach both domestic and international human rights laws.

Which lawyers have advised the NI Department of Health I want to know??

Or is it civil servants just making it up as they go along?

I suspect the latter.

No one has the power or authority to force another person to accept a medical intervention without their FREELY GIVEN informed consent to do so.

Any such regulations to change this are ultra vires their powers and unenforceable.

Giving medical treatment without freely given informed consent is prima facie assault and battery. It breaches the Right to Life and the Right not to be given cruel, inhumane treatment or punishment.

Both of these Rights cannot be derogated from even in times of war or medical emergency.

These civil servants need to be investigated as to which lawyers have advised them and/or whether they’ve even sought legal advice before drafting these regulations.

It actually makes me very angry that anyone thinks they have the right to force anyone else to have a medical intervention.

Who do they think they are???

And yes, individual rights outweigh collective rights in this instance.

Te Whatu Ora has been granted an injunction that prevents anyone in New Zealand OR overseas from publishing the data.
