Gary Gensler’s SEC seems to have, at best, a misguided understanding of what constitutes a security when it involves digital assets. Their approach to regulating anything remotely adjacent to the blockchain, including art and airdrops, is predatory and in some cases—borderline illegal.

Today, I dissected each stage of the process illustrating the disconnect between the SEC’s regulation of physical assets to those on the blockchain.

In the end, we arrived at where we all thought: the SEC has yet to define what the limiting principle is when it comes to NFTs.

I’d like to report that I have resolved my own issue through hard work, perseverance and some help from a guy named Fred.

As much as today sucked sometimes you have to remind yourself

1. Only you can fix the problem when idiots mess things up

2. Always trust a guy named Fred

3. Sometimes it’s thrilling to get into a screaming match with incompetence

The highlight of 3 was when I told a guy if he says the words “I understand” one more time I’m going to lose my mind and he just went dead silent for 5 seconds and then we both laughed.
