Well, it looks like they don’t know what the definition of Human Trafficking is. Let me try and simplify this for them.

Human trafficking is the recruitment, transportation, transfer, harboring, or receipt of a person by means of threat, force, coercion, deception, fraud, or abuse of vulnerability for the purpose of exploitation. ( Sibiya fits in here perfectly)

It has 3 elements. All three must be present for adults. For children, the "means" is not required.

The ACT - What is done:
Recruits, transports, moves, harbours, receives a person.

The MEANS - How it is done:

Force, threat, kidnapping, fraud, deception, lies about a job, abuse of power, abuse of vulnerability (poverty, age, immigration status), debt, giving payments to someone who controls the victim. ( In this case there was certainly abuse of power.

The PURPOSE - Why it is done:
Exploitation, which includes:

- Sexual exploitation / prostitution ( Sibiya did sleep with one of the girls and requested pornographic material from a minor)
- Forced labour / slavery / servitude
- Domestic servitude
- Forced marriage
- Forced criminality
- Removal of body parts / organs
- Child exploitation (including using children in any form of exploitation)

You do NOT need to cross a border. You can be trafficked inside your own town. A boyfriend who forces his girlfriend to sell sex for rent is trafficking. A family who brings a girl from Limpopo to Centurion to work as a maid with no pay and no freedom to leave is trafficking. A job ad for a waitressing job in Dubai that turns into forced prostitution is trafficking.

And for children (under 18): If a child is moved or kept for exploitation, it IS trafficking; even if they said "yes" and even if there was no force. A child cannot consent to exploitation.

In short: Trafficking = Moving / keeping + Controlling through abuse / deception + Exploiting.
