MACUA Calls for an Investigation into Reports by the Director-General of DMPR which has Misled Parliament Regarding the State of Compliance of Mining Companies in South Africa.

continuous failure to adequately regulate mining corporations and its reliance on self-reported, unverified industry statistics, which it uses to paint a false picture of the state of the mining sector. This practice has resulted in misleading information being reported to Parliament and the resultant failure to enforce Social and Labour Plan (SLP) compliance, undermining not only the law, but also the rights and development of mining-affected communities.

MACUA strongly condemns the deliberate exclusion of MACUA from the Portfolio Committee on Mineral and Petroleum Resources’ recent oversight visit to Mpumalanga. Despite multiple requests for the Committee’s programme and prior engagements highlighting our concerns regarding mining accountability, MACUA was intentionally left out of the process.

Zinzi Tom, an affected community member, has taken a courageous stand through @LHR_SA, filing an urgent application in the High Court of South Africa, Gauteng Division, Pretoria. Invoking Section 38 of the Constitution, she demands that the state take immediate responsibility for funding the rescue of artisanal miners trapped in Shafts 10 and 11 of the Buffelsfontein Gold Mine. Her application is a powerful challenge to a system that criminalises those struggling to survive systemic poverty while shielding powerful entities from accountability.
Zinzi’s brother, Ayanda Tom, is among the hundreds of miners trapped underground since July 2024. “I bring this application as an urgent bid to save my brother’s life, in hope that he is still alive,” Zinzi declares in her affidavit. “I also bring this application in the interests of women and children whose loved ones are trapped underground, facing imminent death.”
The case will be heard in the High Court today.

[WATCH] Volunteers have brought another body to the surface in Stilfontein. Zama zamas earlier sent a letter claiming there are more than 100 bodies underground in the disused mine shafts. The Summit is being held at a critical juncture as the government prepares to gazette changes to the Minerals Petroleum Resources Development Act (MPRDA). It is essential that mining-affected and marginalised communities unite to form a strong movement of resistance against efforts by politicians to perpetuate a mining sector that breeds poverty and exclusion for the majority.

The recent ruling delivered on 20 December 2024 by the Pretoria North High Court, dismissing MACUA's application to compel the @GovernmentZA to immediately commence rescue and resurfacing operations and provide food and humanitarian aid to the trapped miners in Stilfontein, amounts to nothing less than a death sentence for those underground. It is a fundamental denial of their right to life.
While the court has affirmed the miners' right to receive humanitarian aid and acknowledged that they are trapped with no alternative source of sustenance, it may have erred in failing to affirm the state's duty and obligation to protect this right. The state bears the responsibility to ensure that the trapped miners' right to life is upheld and realised, especially given its role in engineering the existing crisis.

MACUA would like to thank all the community volunteers, social movements, unions and charitable organisations that have answered our call to attend to the humanitarian crisis unfolding at Stilfontein while the @GovernmentZA and other organs of state, particularly @SAPoliceService , tried to use starvation and deprivation of food as tools to bring about law enforcement.
The community rescue team on the ground has managed to lower down 45kg of e-Pap, 1000 bottles of water and 2000 containers with spoons to Stilfontein today. Special thanks to members of @SAJFP_ , Visual Intifada and the Potch for Palestine community who continue to drive donations for the relief effort.
This is not enough! We need to please keep donating, sharing and raising awareness. We also need to put pressure on the South African Government to do an immediate evacuation of the trapped miners underground. Don’t stop sharing the donation link in your networks and don’t stop talking about this.
