Following distress calls raised through the @LawSocietyofKe Toll Free Line, we set camp at Central Police Station, Nairobi, until 9pm yesternight, where several protestors had been held following arrest during the demonstrations. We held discussions with the OCS over the release of the protestors, but he insisted on holding the protestors overnight to allegedly enable their booking before release in the morning.
This morning, we reported to Central Police Station by 8am to follow up on the release. We were shocked to find that the peaceful protestors were booked with trumped-up charges of mugging. The police have offered no qualification of these allegations, and we therefore demand that the @ODPP_KE desist from allowing vexatious, false charges against the people of Kenya. Nevertheless, we will be in court for the arraignment of all those arrested and will defend them against these spurious claims.
Our teams across all 23 counties that reported demonstrations have been working diligently to ensure no protestors are detained unlawfully. We secured the release of protestors in Kitengela, Kahawa, and Mombasa and will continue to monitor the situation and offer relevant legal intervention. We urge members of the public to continue bringing information to our attention to enable expeditious action on our part.
Today's homework to all Law Students in the Republic, the Supreme Court of Kenya continues to offer guidance to the courts and the public by settling the law. Plz read the following sample landmark decisions from the court.
1. Rights Jurisprudence - Mothers’ of Political Prisoners Case.
2. On social and economic rights- Mitu-Bell Welfare Society Case.
3. The Court has also held that the right to housing does not extend to squatters or landless persons who occupy private land illegally, but they still have the right to dignity, life and security during eviction. This is the principle developed in the William Musembi Case.
4. The Court has held that the right to a fair trial includes the right to mitigation before sentencing. This was in the Francis Karioko Muruatetu Case where the Court held that the mandatory death sentence for murder is unconstitutional for violating this right.
5. In the CMM v Standard Media Case the Court distinguished between public law and private law remedies.
6. The Land Question and Land Grabbing- The Court applied the principle in Article 40(6) of the Constitution in the Dina Management Limited Case, where it held that a title or lease that was issued irregularly or unlawfully cannot be held as indefeasible, and that the ownership of such land cannot be protected under Article 40 of the Constitution. The Court also applied this principle in the Torino Enterprises Limited Case, where it held that an innocent purchaser for value without notice must be a diligent purchaser who inspects the premises before buying. It means that the root of the title is crucial in determining the validity of a title.
7. The implication of this jurisprudence on ‘land grabbing’ is that innocent purchasers should seek indemnity from land grabbers but illegally and irregularly acquired public land must revert to the state.
8. In Isack M’inanga Kiebia v. Isaaya Theuri M’lintari & Another determined the juridical status of customary trust in land.
9. Judicial Review Beyond the Frontiers of the Common Law - The Court in the Dande Case.
