Initial registration period for FY2024 H-1B cap will occur from 12:00 pm (ET) on 03/01/2023 through 12:00 pm (ET) on 03/17/2023. Prospective petitioners/representatives can submit registrations on the online H-1B registration system.

USCIS is extending the validity of Green Cards for petitioners who properly file Form I-751 or Form I-829 for 48 months beyond the card’s expiration date. This change started on 01/11/2023 for Form I-829 and will start on 01/25/2023 for Form I-751.

USCIS recommends for Family based I-485 Petitions, Applicants should include the I-693 (Report of Medical Examination) at the time of filing to potentially speed up processing time
USCIS is automatically transferring some unreceipted H-1B cap petitions sent to Vermont Service Center (VSC) to California Service Center. USCIS is asking petitioners to continue sending petitions to VSC as normal, and not to send duplicate filings due to receipting delays.

USCIS is taking steps to expand premium processing. By the end of fiscal year 2022, 30-45 calendar day premium processing is expected to be available for I-539 filings to change to F, J, or M status, and F-1 OPT and J-2 exchange visitor I-765 filings for $2,500 per application.
I-539 premium processing will provide greater flexibility for foreign nationals already in the U.S. who wish to study, and the expansion of I-765 premium processing is a boon for companies wanting to retain foreign national talent in the currently strained labor market.
USCIS is issuing most Employment Authorization Documents (EAD) and Advanced Paroles separately to expedite EAD processing times; it is unknown when they will issue accompanying APs. Be sure to read the bottom of any new/recent EAD card to verify if it allows reentry to the US.

After 3 rounds, USCIS has completed its annual selection of H-1B cap-subject visas for start dates 10/2021 – 9/2022. Registration for this upcoming year’s selections begins tomorrow and ends 3/18. USCIS will complete the 1st round of selections by 3/31.
