2026年8月28號,第十四屆全國人大常委會第二十四次會議通過咗修訂版《中華人民共和國國防動員法》。呢條法律原本喺2010年制定,今次係大修,新法將會喺2026年10月1號正式生效。

對中國人嚟講,呢係一件關於戰時動員制度嘅立法大事。

但對香港人嚟講,問題係:呢條法律,會唔會套用嚟香港? 修訂後嘅《國防動員法》,內容比舊版詳細好多,總共十四章、八十二條。同一般市民關係比較直接嘅,主要係以下呢幾個部分。 第五十八條訂明,18歲至60歲嘅男性公民、18歲至55歲嘅女性公民,原則上都要依法擔負「國防勤務」, 即係支援保障軍隊作戰、預防救助戰爭災害、協助維護社會秩序等任務。

條文亦都列明幾類人可以獲豁免,例如懷孕或者哺乳期女性、喪失勞動能力人士、從事托兒育兒教育工作嘅人員等。 至於邊啲行業要優先配合方面,第六十條列明,交通運輸、郵政、電信、網絡安全、醫藥衛生、食品糧食供應、工程建築、能源化工、大型水利設施、民用核設施、新聞媒體、國防科研生產、市政設施保障等單位,「應當依法擔負國防勤務」。

另外,第七十三條規定,一旦國家決定實施國防動員,可以喺實施區域內採取特別措施,包括對金融、交通運輸、電信、新聞出版、廣播電視、信息網絡、能源水源供應等行業實行管制,限制人員活動嘅區域、時間、方式,以及物資運載工具進出嘅區域,喺機關團體同企業事業單位實行特殊工作制度,同埋為武裝力量優先提供交通保障。呢啲條文,係針對「國家決定實施國防動員」呢個特定狀態之後嘅措施,並唔係日常狀態下就會自動觸發。

咁樣,呢條法例宜家套用緊喺香港未?

答案係:宜家未有。呢個唔係我哋嘅推測,而係《基本法》白紙黑字寫明嘅制度安排。

根據《基本法》第十八條:「在香港特別行政區實行的法律為本法以及本法第八條規定的香港原有法律和香港特別行政區立法機關制定的法律。全國性法律除列於本法附件

換句話講,全國性法律唔會自動喺香港生效,除非佢被列入《基本法》附件三。而附件三入面嘅法律,亦都有範圍限制——只限於「有關國防、外交和其他按本法規定不屬於香港特別行政區自治範圍的法律」。

截至而家,《國防動員法》未有被列入附件三嘅公開紀錄。 但係,呢度有兩個位要留意。

🚨Today, two British judges dismissed @StopTheEmbassy's High Court challenge against the decision to grant China planning permission to build a new mega-embassy spy-hub in London.

Responding to the news, our policy and advocacy manager, @Chloe_chc_25, said:

"This is disappointing, but it's anticipated. The residents will now apply for permission to appeal, and we will support the residents in every way possible.

"For many people, this isn't just about a building. It's about whether people can truly feel safe in Britain.

"As someone targeted by the Chinese Communist Party, I know why it's so important that Britain protects itself from foreign intimidation. I came to Britain to find safety, and I don't want to spend the rest of my life looking over my shoulder.

"Even if this decision creates fear, disappointment, or makes people feel vulnerable, fear will not determine what we'll do next.

"We'll continue to stand up, speak out, and fight for our rights. We'll continue supporting the residents through every legal avenue available.

"We knew this would be a long fight, but we'll not walk away — the stakes are just too high."

我來英國近5年，雖然有協助朋友經驗，都是第一次要在幾天就要找到解決辦法。這7天我志偉見面時間多過見樹英。早出深夜歸。

咁！點解會發生問題？
志偉同民主黨朋友在志偉出發前，已經通知左香港英領事館高層。英領使亦實際有知會Heathrow Border Control. 志偉一入境, Immigration Officer 睇過電腦，就知有Signal/Alert. 但跟著反而是一個最長查詢。跟著便發出7天Removal Order.
我第一個問題就是。尤竟香港英領事館高層pass 左一個乜野Note /Request 比Border Control. 是A一個Straight Pass Request. 還是只是一個B. JUST Alert. 我現在估計是B.
因為係當天機場就另一個Foreign Office junior staff. 她知道發生左事。她未夠authority 可以見Border Control 既Chief. 不能即埸解決問問題。

跟著幾天便是social media 新聞滿天飛。因為一些考慮。初期是團隊想低調一些。尋找空間處理。甚至有律師非常樂觀可以順利解決。幾天形勢是無一個Home Office. Minister 級officer 聯絡我地。兩天後，我在內部便建議及堅持一定要開始聯絡各方議員及媒體，比Home Office 壓力（因爲我從政幾十年我從來不相信單單有法律根據，道理便能改變政府決定。要加上政治壓力）所以志偉便有美聯社AP Times 及BBC 訪問。我有聯絡上下議院議員寫信比Minister.

最大Turning Point 我揾到IPAD Luke. 星期日早上通左電話。Luke 揾左Lord Alton. Lord Alton 立即寫信比Minister Hanson. 因爲Lord Alton 係very senior. Minister Hanson ，3小時後，係星期日6pm 覆Lord Alton. 他知道這件事。星期一早上會處理。這是我們團隊第一次知道有一個有名有姓 senior Minister 處理這事。
星期一又開會。心急等到Noon. 無消息。我為有再搵Luke. Luke 立即再跟進。230pm. 我收到Luke 電話，話Lord Alton 收到Minister Hanson formal reply. 志偉will not be deported. 我再問。幾時有written confirmation. Luke said one hour later. 我立即將這好消息話比志偉知。
One hour later. Paul Harris 及律師團收到Home Office reply.
志偉立即去機場取回passport. 順利。

係尼7日，好多朋友text message我。又好多香港人自發寫信比MP. 好多我聯絡過政界朋友Lord Patten . Ben. Nathan . Chole. 家倫．Megan Thomas. Taylor .Bobby. Richard等等大力協助。對香港人、政界朋友及律師，我們無言感激。

問題解決，當我同志偉擁抱時，兩個都喊左出來。
因為香港人的精神真的是very powerful. 令人好感動。
這種團結，一方有難，百分支持。就是我們香港群體生命力。
我地當然要跟進後續工作。令這種事不要再發生。
