THE PERJURY CARD: Lacson’s Dangerous Play

——Lacson now chairs the Senate Blue Ribbon, but critics fear he’s siding with Marcos, Romualdez, and Zaldy Co. His perjury threats against whistleblower Orly Guteza risk turning the Senate into a tool for the powerful—not a platform for truth.——
The saga of Retired MSgt Orly Guteza has exposed not only the fragility of technical paperwork but also the rottenness of a Senate increasingly perceived as a puppet of Malacañang. His affidavit, denied notarization by a supposed lawyer, is already being used to discredit him. But Guteza did what few dare—he swore before the Senate itself, under oath, on the very substance of that affidavit. That act alone carries more weight than any notarized document could.
The law is unequivocal. Under Article VI, Section 21 of the 1987 Constitution, the Senate wields the power to summon witnesses and receive testimony in aid of legislation. In Arnault v. Nazareno (1950) and Bengzon v. Senate Blue Ribbon Committee (1991), the Supreme Court affirmed that testimony under oath before Congress is binding, enforceable, and punishable by perjury if false. Guteza’s words cannot be erased by a lawyer’s denial of notarization. What matters is that the testimony is on record, under oath, before the people’s representatives.
The affidavit’s defect raises another issue: the accountability of the notarial lawyer. The 2004 Rules on Notarial Practice require every notarization to be recorded in a notarial register. If the lawyer is lying, or if the affidavit was deliberately sabotaged, then the notary is the one liable—for negligence, malpractice, or worse, for deliberate obstruction of truth. That investigation must be done, if only to prevent notarial practice from being weaponized in political warfare.
But the real scandal lies not with Guteza, but with the Senate itself. The so-called Senate coup that ousted Chiz Escudero as Senate President and Rodante Marcoleta as Blue Ribbon Committee chair, replacing them with figures friendlier to Malacañang, is nothing short of a recalibration to shield President Ferdinand Marcos Jr., Speaker Martin Romualdez, and Rep. Zaldy Co. The installation of Ping Lacson as Blue Ribbon Chair is especially alarming. Once respected as an independent voice, Lacson now risks becoming the enforcer of perjury rhetoric against whistleblowers, while conveniently sidestepping the accountability of those in power.
Senator Lacson must be warned: the people can see through this partisan maneuver. They know the Senate is being re-engineered to protect Malacañang’s interests, not the people’s. If Lacson chooses to wield the threat of perjury as a political bludgeon against Guteza instead of pursuing the truth of his revelations, he will go down in history not as a reformist, but as another cog in the Marcos-Romualdez machine.
The Filipino people are not blind. They understand that Guteza’s testimony, flawed affidavit or not, has already pierced through layers of political deception. What they will not forgive is a Senate that once again betrays its constitutional duty in favor of the powerful. The Blue Ribbon Committee was designed to expose corruption, not to cover it up with legal technicalities and partisan games.
The question now is clear: will the Senate serve as a platform for truth, or will it collapse into Malacañang’s shield? For Guteza, the risk is perjury if he lies. For Lacson, the risk is far greater—the condemnation of a people who will not tolerate another betrayal in their name.
