Finance Bill 2026 has a serious contradiction in trust taxation.

The Bill says:

• Trustees pay full tax on trust income
• Beneficiaries receive tax free distributions

This is clean and simple.

But here is the problem.

Section 5(jb) of the Third Schedule to the Income Tax Act still says:

• 25% withholding tax applies on distributions to beneficiaries
• Under Section 11(3)(c)

What's the problem?

• The Bill has deleted Section 11(3)(c)

Meaning:

• One law says no tax
• Another says 25% tax
• And the section it refers to no longer exists

Implications:

- Confusion for trustees
- Risk of double taxation
- Guaranteed court battles
