امروز، سالروز امضای فرمان مشروطیت در ۱۴ مرداد ۱۲۸۵، برای ما یادآور یکی از بزرگ‌ترین جنبش‌های تاریخ معاصر ایران است، جنبشی که از دل اندیشه و تلاش ده‌ها ساله‌ی ایران‌دوستانی برخاست که از عقب‌ماندگی و نابسام��نی ایران در دوران قاجار رنج می‌بردند.

آرمان مشروطیت بر سه اصل بنیادین استوار بود:
حاکمیت قانون،
حاکمیت ملی و اراده ملت،
و پیشرفت و ترقی ایران.

مشروطه‌خواهان به‌خوبی دریافته بودند که بدون قانون، دادگستری مدرن و سامان اقتصادی، استقلال و پیشرفت کشور امکان‌پذیر نخواهد بود. شاید بتوان سخن ابوالحسن‌خان‌ پیرنیا، نماینده تهران در جلسه ۱۵ شهریور ۱۲۸۶ نخستین مجلس شورای ملی، را چکیده و تجلی خواست آنان دانست:

«ایرانیان را دیگر جان به لب رسیده است؛ دو چیز لازم داریم، یکی مالیه و یکی عدلیه.»

کتاب «یک کلمه» اثر میرزا یوسف‌خان مستشارالدوله نیز همین حقیقت را یادآور می‌شد: راز پیشرفت کشور در یک کلمه خلاصه می‌شود، قانون.

اما این مبارزه با مقاومت مشروعه‌خواهانی رو��ه‌رو شد که حاکمیت شرع و فقها را بر قانون و حاکمیت ملی برتری می‌دادند. آن جریان فکری، دهه‌ها بعد در قالب جمهوری اسلامی و ولایت فقیه بر ایران حاکم شد. تأسف‌بار آنکه امروز نیز برخی جریان‌های سیاسی، هرچند با ظاهری متفاوت، همچنان با اصل حاکمیت ملت و پذیرش رأی مردم به‌عنوان مرجع نهایی تعیین نظام سیاسی آینده ایران مخالفت می‌کنند.

اگرچه آشفتگی‌های سال‌های پایانی حکومت قاجار، و کارشکنی مخالفان مشروطه مانع از تحقق کامل آرمان‌های این نهضت شد، اما بخش مهمی از آن آرمان‌ها در دوره حکومت دو پادشاه پهلوی تحقق یافت و به اجرا درآمد، از جمله با تأسیس دادگستری مدرن، احدا�� راه‌آهن سراسری، نوسازی ارتش، تأمین امنیت کشور، بنیان‌گذاری بانک ملی، سامان‌دهی امور اقتصادی و مالی و ایجاد دیگر نهادهای بنیادین توسعه.

امروز پاسداشت انقلاب مشروطه ��عنی تأکید بر حاکمیت قانون، رأی و اراده ملت، جدایی کامل دین از حکومت، و بازگرداندن ایران به ریل ترقی و تمدن.

بر همین اساس، برنامه من برای هدایت ایران در دوران گذار بر برگزاری انتخابات آزاد، حاکمیت رأی ملت، تشکیل مجلس مؤسسان برای تعیین مسیر آینده کشور و فراهم آوردن زمینه شکوفایی و رفاه برای همه ایرانیان تأکید دارد.

سالروز صدور فرمان مشروطیت گرامی باد و یاد همه تلاشگران راه آزادی، قانون و پیشرفت ایران جاودان.

To @BrotherRasheed’s point: under international law, migration management is a shared responsibility. #Spain has the right and duty to protect its borders, but #Morocco also has the obligation to prevent and combat organized irregular departures from its own territory.

Allowing or facilitating mass unlawful crossings shifts the burden to the destination state and undermines bilateral migration agreements.

The situation in #Spain will get more complicated than before. Under current international law, all three actors have different legal obligations.

Morocco must prevent and not facilitate irregular departures, combat migrant smuggling under the UN Convention against Transnational Organized Crime and its Smuggling Protocol, and cooperate in good faith with neighboring states. If it is knowingly directing or enabling mass crossings, that raises serious questions of state responsibility.

Spain has the sovereign right and obligation (under the Schengen Borders Code) to protect the EU's external border, intercept irregular entries, process asylum claims individually where required, and return those without a legal right to remain while respecting human rights.

The European Union cannot leave Spain to handle this alone. Under the Treaty on the Functioning of the EU (Article 80), migration and border management are governed by the principle of solidarity and fair sharing of responsibility. That means operational support through Frontex, financial assistance, intelligence sharing, and, if evidence shows migration is being deliberately instrumentalized by a third country, a coordinated diplomatic and legal response.

The main legal question is whether a third state deliberately facilitated the crossings. If that is established, international law on state responsibility, in addition to migration law, becomes directly relevant.

Under international law, people have the right to seek asylum, but no NGO has a legal right to facilitate or encourage unlawful entry into another sovereign state's territory. If NGO members knowingly organize, direct, or materially assist illegal border crossings, domestic criminal laws on migrant smuggling or aiding unlawful immigration may apply. Humanitarian assistance is protected; facilitating illegal entry is a separate legal question that authorities are entitled to investigate.

States also have the right and the obligation to secure their borders while respecting human rights. Sovereignty, border security, and refugee protection are complementary principles under international law, not competing ones.

And one final point for @visegrad24: whether the migrants come from the Third World or the wealthiest countries on Earth is legally irrelevant. Illegal entry is illegal entry. The legal question is how the border is crossed, not where the migrants come from.

Today, many were shocked by yet another video of the drone “safari” Russians are carrying out against civilians in Kherson. A Russian drone deliberately hunted down a man selling vegetables and detonated right next to him. The Russians even admitted to the crime, showing zero regret and openly boasting about tormenting people. The man was wounded in the blast. Every single day, ordinary people in Kherson face these Russian "safaris."

The world must see this. It must see every piece of evidence that Russia has gone mad and that its soldiers take pleasure in killing and abusing civilians. Without pressure on Russia, the dismantling of its capacity for aggression, and real security guarantees, it is simply impossible to imagine the world being able to coexist with this evil. We must remain resolute in defending life. We must act and support life in ways that force Russia to seriously think about peace rather than expanding the range of its drones.

This is not just about Ukraine. Russia’s campaign against human life must be stopped here in Ukraine before it spreads further. Finland and Kazakhstan, the Baltic states and Poland, the countries of the South Caucasus, Romania, and Moldova—all should work together to ensure real security guarantees and bring Russia’s war to an end.
