Axis Bank lent Sundev Appliances ₹16.69 crore in 2013 against a Vasai property in MH. The borrower stopped paying. The account went NPA in 2017. The bank moved to seize the security. The defaulter ran to the National Commission for ST and branded it an SC/ST Act offence! The NCST summoned MD & CEO Amitabh Chaudhry in person.
Bank went to the Delhi HC. In Oct 2025, Justice Sachin Datta stayed it. He said the summons to Chaudhary had no jurisdiction but the case is still going on.

It’s sickening the kind of hardship people can be put through for simply doing their job. The defaulter ducked the loan. NCST dragged bank’s top officials into it. Staff who only did recovery work get treated like criminals. How is a defaulted loan recovery an atrocity? SC/ST Act is meant to stop real attacks on SC/ST people, not to shield a defaulter from a mortgage. This is total misuse of act.

जो व्यक्ति या संस्था इस काम को 5 करोड़ में कर सकती थी, वह इस टेंडर में अप्लाई ही नहीं कर सकती है

कोई कानूनी जानकर बताए कि सरकारी संसाधनों के खुल्लमखुल्ला दुरुपयोग की यह अनुमति संविधान के किस आर्टिकल में लिखी हुई है?

SC/ST एक्ट के केश इसलिए बढ़ गए क्योंकि 2018 के संशोधनों में मुआवज़ा लगभग 80 हज़ार से 8.5 लाख तक पहुँच गया।

अब वही मुआवजा बढ़ाकर 12 लाख तक करने का प्लान है। पैसा बढ़ा, तो फर्जी केस भी 3–4 गुना बढ़े। आगे और इस एक्ट का दुरुपयोग होगा।

देश की करीब 25% आबादी SC/ST है। उनके साथ जो भी घटना होती है, उसे SC/ST एक्ट में डालने को कहा जाता है। प्रीलिमिनरी इन्क्वायरी नहीं। इंस्पेक्टर मना करे तो उसी पर एक्ट लग सकता है। FIR खुद पहली किस्त ट्रिगर कर देती है।

PCR Act इंदिरा गांधी के समय से था। राजीव गांधी ने दलित नेताओं के दबाव और राजनीतिक मजबूरी में SC/ST एक्ट लाया।

2018 में सुप्रीम कोर्ट ने तीन सेफगार्ड दिए, कांग्रेस ने ही भारत बंद का साथ देकर उन्हें वापस करवाया।

और आँकड़ा यह है कि इन केसों का बड़ा हिस्सा OBC पर दर्ज होता है। फिर OBC प्रोटेक्शन एक्ट किससे बचाव के लिए? निशाने पर वही जनरल कैटेगरी है, जिसका इन केसों में हिस्सा सबसे कम है।

शिक्षिका की शिकायत पर जब पुलिस टीम स्कूल पहुँची और आरोपी शिक्षक को पूछताछ के लिए थाने ले जाने लगी, तो उसने पुलिस से भी हाथापाई करना शुरू कर दिया।

और पुलिस को धमकाते हुए कहने लगा कि हाथ भी मत लगाना, वरना तुम लोगों पर SC/ST एक्ट लगा दूँगा।
