سعودی عرب، پاکستان اور ترکیہ کے درمیان مشترکہ دفاعی معاہدہ طے!

سعودی عرب، پاکستان اور ترکیہ نے “مکہ مشترکہ دفاعی معاہدے” پر دستخط کر دیے۔

اعلامیے کے مطابق معاہدے کا مقصد تینوں ممالک کے درمیان دفاعی تعاون کو فروغ دینا، علاقائی سلامتی کو مضبوط بنانا اور مشترکہ سیکیورٹی چیلنجز سے نمٹنا ہے۔

معاہدے کی اہم شق کے تحت کسی بھی ایک رکن ملک پر بیرونی مسلح حملہ، تینوں ممالک پر حملہ تصور کیا جائے گا، اور اقوام م��حدہ کے چارٹر کے آرٹیکل 51 کے تحت اجتماعی دفاع کا حق استعمال کیا جا سکے گا۔

"While marking 7 years of India's illegal & unilateral actions on 5 Aug. 2019, we honour the sacrifices of the IIOJK #Kashmiris in their just struggle for their right to self-determination.

India's actions of 5 Aug. 2019 contravene several United Nations Security Council (UNSC) resolutions which stipulate that the final disposition of the State of Jammu & Kashmir 'll be made in accordance with the will of the people through a free and impartial plebiscite conducted under the auspices of the United Nations.

India is implementing a brutal campaign of military occupation, land confiscation, and the influx of non-Kashmiris in the Indian Illegally Occupied Jammu and Kashmir (IIOJK) in violation of the UNSC resolutions and International Law, including the 4th Geneva Convention,

More than 1.5 billion people at the region deserve to see the dawn of peace, which has been held hostage by India in IIOJK.The resolution of the Jammu & Kashmir dispute in accordance with the relevant UN Resolutions & the wishes of the Kashmiri people is the only wayto ensure durable peace and stability in the region."

On the occasion of Youm-e-Istehsal, Field Marshal Syed Asim Munir, NI (M), HJ, Chief of Army Staff & Chief of Defence Forces; Admiral Naveed Ashraf, NI, NI (M), T Bt, Chief of the Naval Staff; Air Chief Marshal Zaheer Ahmed Baber Sidhu, NI (M), HJ, Chief of the Air Staff and the Armed Forces of Pakistan, reaffirm their unwavering solidarity with the resilient and courageous people of the Indian Illegally Occupied Jammu and Kashmir (IIOJK).

The Armed Forces of Pakistan reiterate their steadfast support for the legitimate struggle of Kashmiri people to exercise their inalienable right to self-determination as enshrined in International law and the relevant United Nations Security Council resolutions.

The continued illegal occupation of IIOJK by Indian security forces, marked by military siege, rampant human rights violations and attempts to alter the demographic composition of the territory, remains a matter of serious concern. Such actions, coupled with provocative rhetoric and belligerent posturing, serve only to exacerbate regional instability and perpetuate human suffering.

It is explicitly evident that lasting peace and stability in South Asia are intrinsically linked to the just and peaceful settlement of Jammu and Kashmir dispute in accordance with aspirations of the Kashmiri people and the relevant United Nations Security Council resolutions.

The people and Armed Forces of Pakistan pay solemn tribute to the martyrs of IIOJK and reiterate their enduring commitment to stand shoulder to shoulder with the Kashmiri people in their just and rightful struggle for freedom.

5 اگست 2019 کے بھارتی اقدام کی کم از کم بارہ بنیادوں پر قانونی کمزوری

“5 اگست 2019 نے ممکن ہے بھارت کے داخلی آئینی قانون کو تبدیل کر دیا ہو، لیکن اس نے جموں و کشمیر کے بین ا��اقوامی قانونی سوال کو تبدیل نہیں کیا۔”

5 اگست 2019 کے بھارتی اقدام کو کم از کم درج ذیل بارہ بنیادوں پر قانونی طور پر قابلِ اعتراض اور کمزور قرار دیا جا سکتا ہے:

1۔ بھارت نے ایک ایسے آئینی تعلق کو یک طرفہ طور پر تبدیل کر دیا جو تاریخی طور پر الحاق کی دستاویز (Instrument of Accession) میں اپنی بنیاد رکھتا تھا۔

2۔ بھارت نے آرٹیکل 370 کو غیر مؤثر اور آرٹیکل 35-A کو ختم کر دیا، جبکہ جموں و کشمیر کے عوام کی رضامندی کسی نمائندہ آئینی عمل کے ذریعے حاصل نہیں کی گئی۔

3۔ بھارت نے جموں و کشمیر کے سابقہ عدالتی نظائر کو نظر انداز کیا، جن میں ریاست کی باقی ماندہ آئینی خود اختیاری (Residual Constitutional Authority) سے متعلق اصول شامل تھے، خصوصاً جموں و کشمیر ہائی کورٹ کے مئی 1951 کے مقدمہ Maghar Singh کے فیصلے کو۔

4۔ بھارت نے ریاست کی جانب سے وقتاً فوقتاً دی جانے والی آئینی رعایتوں، بشمول 1959 میں ریاست میں داخلے کے پرمٹ (Entry Permit) کے نظام کے خاتمے، کو اس طرح پیش کیا جیسے یہ ریاست کی باقی تمام آئینی خود اختیاری سے ناقابلِ واپسی دستبرداری کے مترادف ہوں۔

5۔ بھارت نے اس حقیقت کے باوجود یہ اقدام کیا کہ خود بھارت نے پہلے تنازعۂ جموں و کشمیر کو اقوام متحدہ کی سلامتی کونسل کے سامنے پیش کیا تھا اور اس کے نتیجے میں ایک بین الاقوامی قانونی و سیاسی فریم ورک وجود میں آ چکا تھا۔

6۔ بھارت اپنے داخلی آئینی قانون سازی کے ذریعے اقوام متحدہ کے منشور (UN Charter) کے تحت اپنی عائد ذمہ داریوں کو ختم نہیں کر سکتا۔

7۔ یہ اقدام UNCIP کی 13 ا��ست 1948 اور 5 جنوری 1949 کی قراردادوں کے ذریعے وضع کیے گئے سیاسی و قانونی فریم ورک سے مطابقت نہیں رکھتا، جن میں مسئلۂ الحاق کا فیصلہ آزادانہ اور غیر جانب دارانہ استصوابِ رائے (free and impartial plebiscite) کے ذریعے کرنے کا تصور موجود تھا۔

8۔ بھارت یک طرفہ داخلی آئینی اقدام کے ذریعے جموں و کشمیر کے حتمی تص��یے سے متعلق اقوام متحدہ کی سلامتی کونسل کے متعلقہ فریم ورک کو نہ تو ختم کر سکتا ہے اور نہ ہی ماضی پر لاگو کرتے ہوئے بے اثر کر سکتا ہے۔

9۔ بھارت نے جموں و کشمیر کے مستقبل سے متعلق اپنے تاریخی عہد و پیمان، یقین دہانیوں اور وعدوں کو نظر انداز کیا۔

10۔ سابق ریاست جموں و کشمیر کے عوام نے بین الاقوامی سطح پر زیرِ غور حقِ خود ارادیت (self-determination) کے طریقۂ کار کے ذریعے 2019 کی آئینی تبدیلی کو اجتماعی طور پر کبھی منظور نہیں کیا۔

11۔ بھارت کی سپریم کورٹ حکومتِ ہند کے اقدام کی داخلی آئینی حیثیت کا تعین کر سکتی تھی، لیکن اس کا فیصلہ بذاتِ خود بین الاقوامی تصفیہ نہیں بن سکتا، نہ ہی وہ اقوام متحدہ کے فریم ورک سے پیدا ہونے والے عوام کے حقوق اور ریاست کی بین الاقوامی ذمہ داریوں کو ختم کر سکتا ہے۔

12۔ 2000 کی ریاستی خود مختاری کمیٹی (State Autonomy Committee) کی رپورٹ اس امر کا ثبوت ہے کہ جموں و کشمیر کے اندر بھی بھارت کے ساتھ آئینی تعلق کی نوعیت ایک متنازعہ مسئلہ رہی، اور ریاست کا بھارت میں مکمل آئینی انضمام (Complete Constitutional Merger) ایک متفقہ یا غیر متنازعہ آئینی موقف نہیں تھا۔

بنیادی قانونی اصول

“بھارت کی سپریم کورٹ یہ طے کر سکتی ہے کہ بھارت کا آئین حکومتِ ہند کو داخلی طور پر کیا کرنے کی اجازت دیتا ہے؛ لیکن وہ اس تعین کے ذریعے جموں و کشمیر کی بین الاقوامی حیثیت کا فیصلہ نہیں کر سکتی، اقوام متحدہ کے فریم ورک کے تحت اس کے عوام کے حقوق کو ختم نہیں کر سکتی، اور نہ ہی بھارت کو اقوام متحدہ کے منشور کے تحت عائد ذمہ داریوں سے بری کر سکتی ہے۔”
