KRA HAS LOST OVER KShs 681 MILLION after the High Court overturned additional income tax and VAT assessments issued against Imara Steel Mills for the years 2015–2019. KRA had accused the company of under-declared income following an audit and slapped it with massive assessments, later ballooning to over KShs 3.9 billion with penalties and interest.

The Court however held that KRA violated the law by failing to properly serve its objection decision within the mandatory 60 days and by reopening tax years that were already time-barred without proof of fraud or evasion. The objection was deemed allowed by operation of law, the Tribunal decision quashed, and KRA’s assessments thrown out entirely.

Random Thought… Employers are really struggling with the employment act during termination.

The court seems to agree that the lawyer, Eurry Mabonga , ought to be sacked for running private practice at work during work hours…

But then goes ahead to award the errant employee because the PROCESS was flawed. Employers like AFC are really struggling with the employment act during termination.
